Dear NHS North Tyneside Clinical Commissioning Group,

Please would you provide the following information for your CCG:

1) the number of deaths of patients with a learning disability that occurred in the last three years (by years defined as 1/4/16 - 31/3/17, 1/4/17 - 31/3/18, 1/4/18 to present).

2) the number of independent investigations into the deaths of patients with a learning disability that you have commissioned in the last three years (defined as above)

3a) the number of deaths of patients with a learning disability that have resulted in an inquest in the last three years (defined as above)

3b) of those inquests the number that were an Article 2 inquest

Dear Hilary,

Sorry it's me again. As per my response to NHS Northumberland can I just confirm that you are stating that the CCG does not hold any information in relation to the deaths of patients with a learning disability? It would seem surprising that you have no overview of this population given your role as commissioner of health services.

It might be that you hold information relating to the deaths of people identified as someone with a learning disability in GP registers? Would there be any information on deaths of people with learning disabilities in the Joint Strategic Needs Assessment (JSNA) that the CCG contributes to? Please could someone check and get back to me to confirm whether they really are not able to answer Question 1.

The Serious Incident Framework states the following in relation to Level 3 Independent Investigations:

'Although the regional team may offer support where it is necessary to do so, independent investigations, and the decision to commission independent investigations, should be managed locally by the commissioner of the care in which the incident occurred wherever possible. Local management and ownership of Serious Incidents is of fundamental importance to ensuring appropriate and timely action'.

Therefore I'm very surprised that the CCG is unable to answer Question 2. Surely a record would be kept as to whether an independent investigation had been commissioned by the CCG or not? I wouldn't like to assume that no investigations have been commissioned but would appreciate confirmation either way.

I'll take it from your earlier response that you do not collect the information requested in Question 3.

I hope someone will be able to confirm with relation to the other questions,

We can only answer the following questions based on the number of deaths the CCG has been informed about, we do not think this is a definitive number.

1) the number of deaths of patients with a learning disability that occurred in the last three years (by years defined as 1/4/16 - 31/3/17 = 5, 1/4/17 - 31/3/18 = 8, 1/4/18 to present = 7).

2) the number of independent investigations into the deaths of patients with a learning disability that you have commissioned in the last three years (defined as above) - none known

3a) the number of deaths of patients with a learning disability that have resulted in an inquest in the last three years (defined as above) - unable to answer

3b) of those inquests the number that were an Article 2 inquest - unable to answer
