In reference to your report 'Investigation into land and property acquisition for Phase One (London – West Midlands) of the High Speed 2 programme’ of 13th September 2018, can you please provide the following:

1. All documents or other evidence used to arrive at the conclusion as stated in point 2.7 of the above document 'the increase in the area of land required is not proportionate to the increase in costs’
2. The methodology used to arrive at the conclusion quoted in point 1
3. Has the NAO independently arrived at the conclusion that 'the increase in the area of land required is not proportionate to the increase in costs’ or has it accepted HS2’s conclusion without an independent judgement of the evidence?
4. The total number of whistle-blowers on the HS2 project that the NAO is aware of
5. The total number of whistle-blowers who were consulted and/or interviewed in the production of this report

I am writing to provide you with a progress update regarding your FOI
request (Ref FOI-1193) for information relating to the NAO’s ‘HS2 Land and
property acquisition’ Investigation.

 

I can confirm that we have identified information in scope of your request
and, as FOIA requires us to do, have consulted third parties whose
interests might be affected by information released in response to the
request.  The consultation has concluded and we are now considering
whether the section 33 (public audit functions) and section 43 (commercial
interests) exemptions apply to any of the information we hold.  These
being ‘qualified’ exemptions, we are required to perform the Public
Interest Test to balance the public interest in disclosure against the
public interest in withholding information in scope of your request. 

 

Regrettably, this means we are not in a position to respond to you within
the 20 working day deadline - FOIA allows us to extend the response
deadline to 40 working days under these circumstances, however, we do not
anticipate a long delay and hope to be in a position to respond to you
soon. 

 

I am sorry for this delay, but we are aiming to finalise our response to
you as soon as we can.
