Dear HM Revenue and Customs,

After recently receiving an email from HMRC I noticed that at the end of the message it was stated "This e-mail may have been intercepted and its information altered". The "small print" also recognises that emails may contain confidential and even legally privileged information and personal data.

Please provide information on the subject of interception (By HMRC) of private emails.

I am writing to request an internal review of HM Revenue and Customs's handling of my FOI request 'Interception of private emails by HMRC'.

Thank you for your response on 20th July to my Request for Information of 22nd June about covert Interception and alteration by HMRC of Personal, Confidential and Legally Privileged emails without the sender or recipients' knowledge.

You Deemed my Request (about secret email interception and alteration by HMRC) as "Trivial" and "lacks purpose".

For that reason I must ask for an Internal Review of that decision.

"Purpose"

The "Purpose" is to determine the lawfulness of HMRC's secret interception of confidential and legally privileged emails and to determine the lawfulness of secretly "altering" the contents of such Private emails.

"Trivial"

Interception of private communications is in many circumstances a criminal offence. And to "alter" the content of a private communication just seems plain wrong - especially as the sender of recipient will never know to what extent the content has been altered and re-altered or if their emails have been altered at all. Such covert practices (such as falsifying the words or numbers given by of a tax-payer or by an Officer of HMRC) might be used to wrongly incriminate someone or to create a liability that does not exist.

Review.

While I am conscious that my email may have been intercepted and your words may have been altered, (especially as you appear to believe such a practice to be too trivial to bother answering), I am also conscious that if my email was not - on this occasion - intercepted and changed before being delivered, you can not be right that interception and alteration in secret of emails is too trivial a matter.

I am concerned that your belief that secretly changing the content of private email, including legally privileged emails, is "Trivial". Please conduct an internal Review.

In case Clarification is Required: I am asking how and why do HMRC covertly intercept and secretly alter the content of private and confidential emails.

Bit strange that an email about an Internal Review of a Response to a Request for Information about HMRC's admitted covert interception of peoples highly confidential including legally privileged emails and about HMRC's admitted editing in secret of those emails before delivery is completed has not been delivered.

To the requester:

The generic footer you see on outbound e-mail from HMRC is merely a reminder that SMTP mail on Internet channels is not safe from interception/modification. If you have a better form of words to explain that, I'm pretty sure they'd be interested, and will modify accordingly.

If you believe those words (added automatically only to outbound e-mail) really imply a secret conspiracy, you should probably speak to experts/lawyers before trying to press this point under FoIA...
