regarding an aspect of the information you are looking to obtain.

 

You have asked for:

 

Please supply copies of all funding decisions, all correspondence, and
subsequent submitted reports by the Royal College of Art and Arts Council
England in regards to the Curating Contemporary Art Inspire Course for the
periods of 2008-2012.

 

Clarification required:

 

Can you please clarify the type of information you mean by all
correspondence?

 

We have interpreted this to be any correspondence between Arts Council
England and the Royal College of Art specifically relating to the delivery
of the Inspire programme that was sent or received between 01 January 2008
and 31 December 2012. Can you please confirm if this is correct?

 

We may also hold correspondence relating to procedural aspects of the
funding for Inspire, for example where we write to an applicant and remind
them to supply a payment condition at a particular date. Would you also
like to access correspondence of this nature? Please note that this type
of correspondence will not include details of the programme itself and so
may not be useful unless you are interested the mechanics of how we
processed the grant payments.

 

We’ve placed your request on hold pending your clarification. Once we have
received your clarification, we will deal with your request in line with
our obligations under the Freedom of Information Act and respond to you
within 20 working days.

Our Response:

 

Please see the attached zip file for copies of the documentation held by
Arts Council England that falls within scope of your request dated 14 May
2019. You will notice that some information has been withheld. I have
explained below why this is the case under our obligations in respect to
the Freedom of Information Act.

 

Section 40(2) – personal data

 

Section 40(2) provides an exemption from the disclosure obligation where
that information is 1) personal data and 2) where releasing the
information would contravene the Data Protection Act 2018. The Arts
Council has a responsibility to hold the personal data of other
individuals securely and in line with the principles of the GDPR and Data
Protection Act.  Releasing this information would contravene the first
principle of fair and lawful processing.
