Dear Forestry Commission,

Under FoI, please could you tell me:

- How many open positions you have for "inside IR35" workers/contractors? (ie. how many positions are you advertising but so far have not found suitable people to fill)
- How many filled "inside IR35" positions do you have? (ie. how many people are working for you with "inside IR35" conditions)

You're welcome to use any time in the recent past for these calculations, although the more recent the better, please (and please tell me what time you used). The length of tenure, either expected or worked is not important - just the number of positions is enough for me.

For example:

"On January 22nd, we had 12 open inside-IR35 positions, and 5 filled".

Yours faithfully,

Ralph Bolton

Lovell, Julia, Forestry Commission

Dear Mr Bolton,

Thank you for your request for information on the number of positions and
workers inside IR35 regulations which you sent in on 21 February 2020 and
we acknowledged on 24 February 2020.

I have now had a chance to consult and collate responses from colleagues
across the Forestry Commission to answer your questions in relation to
employment inside IR35. We do not advertise any posts inside IR35 and so
there are no open positions inside IR35. As at 31 December 2019, we had
zero 'inside IR35' positions filled, ie. we did not have anyone working at
the Forestry Commission on such a contractual basis. I have answered your
questions in respect to the Forestry Commission, and that means on behalf
of Forestry England, Forest Research and Forest Services.

I have tried to deal with your request as fully as possible. If you have
any questions then I would be happy to try and answer these for you.
However, should you wish to complain about the way your request has been
handled please contact:

Complaints regarding non-compliance with the requirements of the open
information legislation should initially be made to the Forestry
Commission itself. We aim to resolve any complaints with you directly.
However, should the matter fail to be resolved, you may make an appeal to
the Information Commissioner’s Office.
