Section 3(2) of the Freedom of Information Act 2000 provides that “For the
purposes of this Act information is held by a public authority if (a)  it
is held by the authority otherwise than on behalf of another person, or
(b) it is held by another person on behalf of the authority.”

 

The Council’s view is that this information is not disclosable under the
FOIA as the Council does not hold this information for their own purposes
but holds it solely on behalf of the Coroner who is not a pubic authority.
The Coroner, as an independent judicial officer, is not subject to the
Freedom of Information Act 2000 and the information is not disclosable.
The information is held by the Council in its role as the relevant
authority for the Coroner (which is a separate statutory function).

 

In accordance with the Freedom of Information Act, if you are not
satisfied with the reply to your request you can ask for a review. A
request for a review must be submitted within 40 working days by emailing

Dear Bradford City Council,

Thank you for your response of even date.

On any independent view, the extension you seek is excessive. Amplified by the fact that you offer no lucid explanation for it.

The same independent observer might well muse, also, what type of Council, with its vast resources and small army of officers paid in excess of £100,000 pa, cannot readily retrieve information of the class sought for disclosure in the instant request.

Accordingly, it seems fair and reasonable to allow your Council 10 further working days to provide a response, after which a section 50 complaint will be lodged with the Information Commissioner's Office.

decision made under the Freedom of Information Act 2000. I apologise for
the delay in sending this response due to competing work pressures.

 

I have considered the information presented to me.

 

The information you request is held in pursuance of the Coroners and
Justice Act 2009 and the Coroners Allowances Fees and Expenses Regulations
2013. The Council is the relevant authority pursuant to Schedule 2
paragraph 3 Coroners and Justice Act 2009 . Bradford Council’s legal
Services department represented HM Assistant Coroner in the court
proceedings.  

 

In view of the above I agree with the response sent to you  from the
Coroner’s Services Manager. As stated in that response Section 3(2) of the
Freedom of Information Act 2000 provides that “For the purposes of this
Act information is held by a public authority if (a) it is held by the
authority otherwise than on behalf of another person, or (b) it is held by
another person on behalf of the authority.”

 

The Council’s view is that the information is not disclosable under the
FOIA as the Council do not hold this information for their own purposes
but hold it solely on behalf of the Coroner.  As the Coroner is an

discharge its burden to those funding them: Bradford council  tax payers.

A section 50 complaint has been lodged with the Information Commissioner's Office.

No interested parties were funded from the Council’s budget.

 

3. Finally, please provide the sum budgeted to spend on the subject
inquest in the financial year ended 31st March, 2022.

 

Legal expenses incurred in the financial year ending 31.3.2022 -
£211,273.50

 

Total spend in relation to this inquest in the financial year ending
31.3.2022 (this includes the above legal expenses,  jury expenses,
transcription charges, Assistant Coroner fees ) £330,405.27    

 

 

The Coroner’s jurisdictional area West Yorkshire (Western) covers the
local authority areas of Bradford, Calderdale and Kirklees. City of
Bradford Metropolitan District Council is the designated  “relevant
authority”  for West Yorkshire (Western) Coroner’s area  (paragraph 3 of
Schedule 2 of the Coroners and Justice Act 2009).  The  Coroner’s area is
funded by the three local authorities proportionately with respect to
their populations. As the relevant authority , Bradford Council
administers the reimbursement of legal expenses reasonably incurred when
proceedings are issued against a Coroner on behalf of the Coroner and
invoices Calderdale and Kirklees Councils for their proportion of the
costs of the Coroner Service.  

 

 In 2019 Judicial review proceedings were issued against a  HM Assistant
Coroner West Yorkshire (Western) in respect of a ruling he gave in a
pre-inquest review in respect of screening of certain witnesses at the
inquest into the sad death of Andrew Hall.  There were a number of
interested parties to the court proceedings.  HM Assistant Coroner took a
non-adversarial stance in response to the claim. The proceedings were
heard in the High Court and then the Court of Appeal in October 2020. The
Court of Appeal reinstated the Assistant  Coroner’s decision.  Bradford
Council’s Legal Services team represented HM Assistant Coroner in the
court proceedings. Bradford Council was not a party to the proceedings. 
The inquest took place with a jury over 10 weeks from April 2021. Counsel
to the inquest was appointed.

 

In accordance with the Freedom of Information Act, if you are not
