I write in connection with your request for information dated 21^st
January concerning correspondence.

 

Specifically you asked: “Please forward me any correspondence between Dr
David Bulpitt, FMA, Dr Philip Johnson, SMP from Dorset Police and the HR
department within Avon and Somerset Constabulary regarding the injury on
duty pension reviews.  Please look for correspondence from 1st May 2014
until 21st January 2015. This will include emails, letters and memos.”

 

Please find attached 14 emails that have been identified as relevant to
your request. With regard to email 1 the attachment referred to relates
simply to the question to Forces concerning if they are currently
reviewing injury awards. You will notice some redactions in emails. All
these redactions relate to personal information. In addition direct
telephone numbers have also been redacted together with the direct email
address of individuals not directly employed by Avon and Somerset
Constabulary. The exemption applicable to these redactions is Section
40(2), third party personal information. This is an Absolute exemption so
therefore there is no requirement to conduct a harm or public interest
test. Any information is exempt from disclosure under the Freedom of
Information Act if it relates to or is supplied by another individual and
disclosure of that information would contravene any of the principles of
the 1998 Data Protection Act, in this particular case, disclosure of this
information would contravene Principles 1 and 2 of the Act, whereby
personal data shall be processed fairly and lawfully and only obtained for
one or more specified purpose or purposes.

Further to my email below I have just re read your email of the 10th April, requesting the three months' worth of 'unaccounted' emails. (1st Nov - 21st Jan).
This time frame had already been considered in our initial response. No emails were identified in that period, therefore there was no information to provide.

Dear Avon and Somerset Constabulary,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Avon and Somerset Constabulary's handling of my FOI request 'Injury on duty pensions'.

Please investigate this request as there are nearly three months worth of email traffic unaccounted for.

I do not believe that there is no email traffic between the parties during this time period.

November and December was a period when the force were physically reviewing injury on duty officers and I am well aware that during this time, emails would have been at their highest.

This matter will be passed to the ICO if you uphold this FOIA.
