I'd be grateful if you can provide me with the following information under the Freedom of Information Act 2000.

1. A list of business/commercial premises owned or leased to the council. Please include;

Gas supply details (MPRN)
Gas usage, kwh per year
Gas rates paid
Electric supply details (MPAN)
Electric usage, kwh per year
Electric rates paid
Current Suppliers
Contract end dates

2. Name, position and email address of the staff responsible for the arrangements of energy contracts/purchasing, together with the telephone number for the department (direct dial not expected given GDPR.)

for Council buildings.

 

I can confirm that this is being considered under the Environmental
Information Regulations 2004 (EIR), as opposed to under the Freedom of
Information Act. This is because the information you have requested
concerns ‘activities’ and ‘administrative measures’ which are likely to
affect elements of the environment under Reg 2(1)(c).

 

Due to the complex nature of your request and relevant members of staff
being on annual leave, I regret to inform you that we will be unable to
meet the deadline originally specified for your request ref: 275697

 

Reg 7(1) of the EIR, however, does allow the Authority to extend the 20
working day deadline to 40 working days in the event of such complications
and, given the nature of your request, we feel that it is appropriate to
do so in this instance.

 

I would like to reassure you, however, that your request is under active
consideration, and that we hope to be able to respond in full
significantly in advance of this date.

In dealing with your request, please note that we have considered it under
the Environmental Information Regulations 2004, as opposed to under the
Freedom of Information Act 2000. This is because the information you have
requested is information involving ‘activities’ and ‘administrative
measures’ which are likely to affect elements of the environment under Reg
2(1)(c).  I am advised that both the domestic and European courts give
wide meaning to the Regulations and have indicated that they will adopt a
broad construction of the definition of environmental information.
