The details we require are:

• Who is the senior officer (outside of procurement) responsible for this contract?
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual contract values of each framework/contract (& any sub lots)
• Start date & duration of framework
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?

Thank you for your email of 03 October 2019 requesting information to be
provided regarding our ITT for the Provision of Legal Services to the
General Pharmaceutical Council.

 

In response to the questions you have asked we can confirm that:

 

 1. The contract holder for the GPhC is Adam Elliott Head of Quality,
Monitoring and Concerns

 

 2. The suppliers who submitted a response to the ITT (no PQQ process was
undertaken) are:

o Kingsley Napley LLP
o Plexus Legal LLP and Plexus North LLP

o Ward Hadaway

On 3 October 2019, we notified successful bidders that they were
successful in the tender process. We intend to publish the names of the
successful bidders on Contract Finder and OJEU by the end of the year. The
names of the successful bidders are therefore currently exempt from
disclosure under section 22 of the Freedom of Information Act 2000, which
relates to the future publication of requested information.

 

 3. The estimated value of this contract for the full 5 year term is £3m
(£600,000 per annum approximately). There is however no specific
contract value for each framework/contract and no sub-lots. Work is
allocated on a needs basis and as stated at paragraph 9.2 of our ITT
“Submission of a tender proposal does not commit the GPhC to award an
Agreement, neither, if any Agreement is awarded, would any Agreement
commit the GPhC to send out a minimum number of instructions or volume
of cases.”

 

 4. No contract start date has been agreed as yet; and paragraph 3.1 of
our ITT makes clear that: “The GPhC is seeking the provision of
Fitness to Practice legal services for an initial three (3) year
period. There is also the possibility of extensions beyond the initial
three (3) year term for two (2) periods of up to twelve (12) months
each. No individual extension will be agreed for longer than twelve
(12) months without a review and the total provision of services under
this Agreement will not exceed five (5) years.”

 

 5. There are no framework(s)/contract(s) to be extended or renewed. This
procurement exercise has been undertaken with a view to enter into new
contracts only.
