Information relating to the SCR/TPP Early Adopter Pilot

Roedd y cais yn llwyddiannus.

Dear Sir or Madam,

I would like to make a request under the FOI Act regarding the SCR Pilot within SWEssex PCT.

For the purposes of the Act, the date of your receipt of my request will be 18th August

• Please could you kindly send me the minutes (draft or otherwise) of any SWEssex PCT Summary Care Record and TPP Release 3 Project/Programme Board meeting held between 01.08.08 and 17.08.08, including minutes of the board meeting held on the 8th of August.

• Please could you kindly send me any SWEssex PCT SCR Project/Programme Board Highlight Reports, Update Reports or Progress Reports created or updated between 01.08.08 and 17.08.08.

• Please could you kindly send me any SWEssex PCT TPP Release 3 Project/Programme Board Highlight Reports, Update Reports or Progress Reports created or updated between 01.08.08 and 17.08.08.

• Please could you send me any SWEssex PCT SCR/TPP Release 3 Project Risk Logs, Issue Logs or Decision Logs created or updated between 01.08.08 and 17.08.08.

As per Section 4a of Part 1 of the FOI Act (http://www.opsi.gov.uk/acts/acts2000/ukp...) I would like the information in question held at the time when my request is received (draft or otherwise), except that account may be taken of any amendment or deletion made between now and the latest time by which the information is to be communicated to me, being an amendment or deletion that would have been made regardless of the receipt of my request.

I would be grateful if you would be kind enough to send me the requested information promptly and in any event not later than the twentieth working day following the date of receipt of my request - that is by then end of the working day of 18th September.
If my request is denied in whole or in part, or specific items within the minutes are withheld from disclosure, then you must justify all deletions by reference to specific exemptions of the act, as per Section 17 of the Act (http://www.opsi.gov.uk/acts/acts2000/ukp...). Where you rely on a qualified exemption to withhold disclosure, you are obliged to consider the public interest in your decision and the refusal notice must explain not only which exemption applies and why, but also the public interest arguments addressed in reaching the decision.

I wish to receive the information by email, sent to the address from which this request originates.

I believe such a request would be reasonable in these circumstances.
As per Section 11 of Part 1 of the FOI Act (http://www.opsi.gov.uk/acts/acts2000/ukp...)
I would be grateful if you would "so far as reasonably practicable give effect to that preference"; if you determine that it is not reasonably practicable to comply with this preference then you are required by law to notify me of the reasons for your determination.
I would be grateful if you would kindly acknowledge receipt of this request as recommended by the ICO (“It would be good practice to acknowledge receipt of requests and to refer to the 20 working day time limit, so that applicants know their request is being dealt with.”).

Thank you once again.

Yours sincerely,

Dr Neil Bhatia

Dear Tracey

I note that you have sent the information that I requested to an alternative return address.

This is in absolute breach of the Act.

In my requesting email I clearly indicated a return address, that is the email address from which the request originated. Your are obliged by law to send the information requested to the return address, not any another email address of your choosing.

I refer you - and not for the first time - to the Freedom of Information (FOI) Guidance on Processing Requests
http://www.dca.gov.uk/foi/guidance/progu... which clearly states:

"Return address

There is no obligation to comply with a request for information if it does not give a return address. If a request is received by email and, although no postal address is given, the email address of the sender is included, then this should be treated as the return address."

I am now using a unique and valid email address to track each of my many FOI requests. I clearly stated the return address in my request.

I would be grateful if you would kindly send me the information that I have requested to the return email address that I specified, as you are required to do so by law.

I do not have to remind you that to failing to do so by the 18th of September will render you in breach of the Act, and - once again - I will have to make a formal complaint to the ICO as well as requesting yet another Internal Review.

I do not have to remind you that you have already breached the Act in failing to respond appropriately to previous requests that I have made:

Dear Dr Bhatia

Please find attached the information requested under the Act 2000.

I must apologise for the response being sent to the incorrect e-mail
address.  As you will understand, requests are not the only aspect of my
role and in my haste to get the information to you as soon as possible I
missed the change of e-mail address.

I hope this information reaches you and meets your requirements; and we
will ensure that the return address is checked for any future responses to
you.

Please do not hesitate to contact the PCT if you require anything further.
