Information relating to 10-ct28pw

The request was refused by Kent Police.

Dear Kent Police,

I Mr M Armario am requesting information relating to an incident that has been said to have happened at 10-ct28pw.
it is alleged that the police were called to this address in June 2009.
I understand that due to data protection you may not be able to tell me who the police were called for.
This being said i do not need to know who the police were called for only that they were or were not called because of me as i have absolutely no recollection of this ever happening and no recollection of the police ever being called to this address because of me in all the years at that address and believe this information to be untrue.
I do however remember having to call the police to this address due to disturbances relating to family members who caused criminal damage to this property, can you confirm if such calls requesting police assistance have been made by myself and the dates these calls were made should the other information i have requested be unavailable under the freedom of information act.

Yours Sincerely ,

Mr M Armario

Dear Mr Armario,

Thank you for your request that has been received by the Freedom of
Information team 3 January 2014. As your request was sent to the Freedom
of Information team it is considered to be a request for information under
the Freedom of Information Act 2000.

Information disclosed under the Freedom of Information Act 2000 (FOIA) is
deemed to be released into the public domain, and not just to the
individual requesting the information. It is for this reason that, under
the FOIA, Kent Police can neither confirm nor deny whether the information
that you have requested is held by virtue of the exemption at Section
40(5) which relates to 'Personal Information'. Personal information is
information that relates to a living individual who can be identified from
that information alone or from that information together with other
information in the possession of, or likely to come into the possession
of, the Chief Constable.

In the circumstances, confirming or denying that the information requested
is held under the FOIA would constitute the processing of personal
information contrary to the Data Protection Principles listed at Schedule
1 to the Data Protection Act 1998.

Please note that, were any information relating to you be held it would be
exempt from release under the FOIA by virtue of the exemption at Section
40(1), and were any information relating to third parties be held it would
be exempt from release under the FOIA by virtue of Section 40(2) in
conjunction with Section 40(3)(a)(i); both exemptions also relate to
personal information.

I have attached a summary of your rights under the FOIA to this e-mail.
Should you be dissatisfied with our decision not to confirm or deny that
the information requested is held under the Act then please refer to the
summary of rights for guidance as to the next steps you can take.

There are a number of ways to access information held by public
authorities. The Freedom of Information Act 2000 is just one of these
routes; for details of the other routes please visit the Kent Police
web-site via the following link:

In any case, individuals may apply for information relating to themselves
under Section 7 of the Data Protection Act 1998; this is known as a
subject access request, and is explained at option 2 of the link above.

To assist you, I have forwarded your request to the Subject Access team as
in this case I consider that it is the most appropriate team to deal with
your request. A member of staff from Subject Access team will be in touch
with you in due course.

Should you have any queries in the meantime, please let us know.

Yours sincerely,

Alan Muggridge
