Information on planning applications on land bounded by Chalcroft Lane and the A259 Road northwards to Chichester.

The request was refused by Arun District Council.

Dear Sir or Madam,

I would like a Freedom of Information Disclosure which shows:

1. All planning applications in the past 10 years relating to all land bounded by Chalcroft Lane, North Bersted (as far as the point opposite West Meads Drive) and the A259 Road to Chichester to the border with Chichester District), the names of those submitting the applications and the decisions where these have been made or the current status of the applications, and the basic details of each application.

2. The text of decisions where made, including reasons for refusal, and whether under delegated powers.

3. And in particular to highlight any decisions to refuse on the grounds of the land being in the strategic gap between Arun and Chichester Districts.

4. Also highlight any refused applications for social or affordable housing.

There is currently a major application by the Church Commissioners and a local landowner to build 2000 homes on this land. There have been previous applications for far less turned down by Arun planning authority on the grounds they were in the strategic gap. This request seeks to establish just how many applications have been made in the past ten years and how they have fared.

Thank you for your recent FOI request which has been passed to me to deal
with.

I am unable to accede to your request as the information you seek is
already available by means of the Council's website planning and building
control pages and/or inspection of the relevant planning application
files and is therefore exempt information under section 21 of the Act. I
attach a copy of the relevant section for ease of reference.

Part II Exempt information

21 Information accessible to applicant by other means

(1) Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.

(2) For the purposes of subsection (1)--

(a) information may be reasonably accessible to the applicant even though
it is accessible only on payment, and

(b) information is to be taken to be reasonably accessible to the
applicant if it is information which the public authority or any other
person is obliged by or under any enactment to communicate (otherwise than
by making the information available for inspection) to members of the
public on request, whether free of charge or on payment.

(3) For the purposes of subsection (1), information which is held by a
public authority and does not fall within subsection (2)(b) is not to be
regarded as reasonably accessible to the applicant merely because the
information is available from the public authority itself on request,
unless the information is made available in accordance with the
authority's publication scheme and any payment required is specified in,
or determined in accordance with, the scheme.
