Information on legislation that supports shared lives scheme and inspection

Roedd y cais yn llwyddiannus.

Dear Care Inspectorate Wales,

I would like information about the following please if possible in relation to Shared lives Schemes in Wales to assist me as part of a research project I am doing as a student social worker in Wales.
1- What is the relevant pieces of Legislation that underpins the Shared lives scheme in Wales?
2- Are there any Codes of Practice or Guidance that a Scheme must follow in order to retain their registration.
3. Is there a requirement for shared lives carers to receive supervision that would be a similar requirement for foster carers?
4. Are shared lives carers required to register with the CIW or is this through the registered provider.
5. Are shared lives carers required to register with Social Care Wales?
Your help would be much appreciated

Yours faithfully,
Ann Barrington

Arolygiaeth Gofal Cymru

Dear Ann Barrington

Thank you for your request which we received on 09/03/2020.

The information you have requested is information that is in the public

I have provided answers to your questions below, including links to the
relevant legislation where applicable.

1.    What is the relevant pieces of Legislation that underpins the shared
lives scheme in Wales?

The relevant legislations is 'The Regulation and Inspection of Social Care
Wales Act (Wales) 2016’
[1]http://www.legislation.gov.uk/anaw/2016/... and ‘The
Adult Placement Services (Service Providers and Responsible Individuals)
(Wales) Regulations 2019’
[2]http://www.legislation.gov.uk/wsi/2019/1...

2.    Are there any Codes of Practice or Guidance that a Scheme must
follow in order to retain their registration.

Providers of shared lives or adult placement services must meet the
requirements of the Adult Placement Services (Service Providers and
Responsible Individuals)(Wales) Regulations 2019 and must have regard to
the statutory guidance which underpins these regulations

3. Is there a requirement for shared lives carers to receive supervision
that would be a similar requirement for foster carers?

There is no specific requirement in the Social Services and Wellbeing
(Wales) Act 2014 or the Registration and Inspection of Social Care (Wales)
Act 2016 for supervision of shared lives carers.  However, under The Adult
Placement Services (Service Providers and Responsible Individuals) (Wales)
Regulations 2019, the following requirements are placed on providers of
adult placement services:

·         Under regulation 33, the provider must have policies and
procedures in place for the recruitment and training of adult placement
carers under regulation 33.  The service provider must put arrangements in
place to ensure that adult placement carers receive adequate training to
assist them to provide high quality care and support for individuals in
accordance with their personal plan and to support each individual to
achieve their personal outcomes.

·         Under regulation 34, the service provider must maintain good
professional relationships with an adult placement carer; and encourage
and assist an adult placement carer to maintain good personal
relationships with individuals.

·         Under regulation 35, the service provider must put arrangements
in place to ensure that an adult placement carer has the information they
need to provide care and support to individuals to achieve their personal
outcomes.

4. Are shared lives carers required to register with the CIW or is this
through the registered provider.

No shared lives carers do not register with CIW.  The provider of the
scheme is required to register with CIW as an Adult Placement Service.

5. Are shared lives carers required to register with Social Care Wales?

No they are not required to register with Social Care Wales.

I hope this information is of assistance to you.

Kind regards
