Information on Facilities Management Contracts and/or Frameworks

The request was refused by Manchester Metropolitan University.

Dear Manchester Metropolitan University,

Dear Lancashire Fire and Rescue Service,

I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to any Catering, Cleaning, Security, Technical Services (this includes and planned or reactive repairs & maintenance) and facilities management services you have on contract.

The details we require are:
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual spend on this contract/framework (and any sub lots), from the start of the contract to the current date
• Start date & duration of framework/contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

Thank you for your help.

Yours faithfully,

Alan Smith

Dear Alan,

Please note that FOI requests made for commercial purposes (e.g. for the
purpose of selling goods or services, or to gain competitive advantage
over prospective suppliers) rather than for public interest purposes are
deemed to be vexatious under the Freedom of Information Act. The Courts
have ruled that improper use of FOI (such as no public interest) is a
valid consideration to make when determining if a request is exempt under
s14 of the Act, which relates to vexatious requests. The use of FOI to
gain a commercial advantage or opportunity over another can be included
within the definition of vexatious, as it is improper use of the Act, of
little if any benefit to the wider public. ICO guidance sets out that:
“The public interest here means the public good, not what is of interest
to the public, and not the private interests of the requester.”

In addition, some of the information you have requested is already
publicly available. Information which is already published, either by the
University or externally, is exempt from disclosure under s21 of the Act.
