I have some more questions under the FOI.

In your policy the following are required for persons providing hospitality to Trust Staff:

1. the name of the recipient;

2. the name of the individual who provided the hospitality (where the individual is providing the hospitality on behalf of a company then the company details must also be declared)

3. the venue at which the hospitality was provided;

4. the approximate value of the hospitality or best estimate; and

5. the name and job title of the manager who gave approval to accept the hospitality.

In relation to the CEO hospitality, can you please supply information outlined in 2. and 5. and can you say what contracts the person or company has been awarded in 2008 and onwards.

On point 3. can you say which football match and venue of meal.

Can you please say whether the second ticket was used by an employee of the Trust.

thank you for your reply dated 7th September.
I had some further questions arising from your reply:

Question 1
The FOI reply dated 2nd August 2010 appeared to state that Mr Adler approved his own hospitality from BBraun.

Th Trust Hospitality policy lists the following:
"Guidance for all Trust staff in respect of the receipt of Gifts and the provision and receipt of Hospitality

1. RECEIVING GIFTS
1.1 The receipt of gifts is not part of normal business practice within
the NHS.

1.2 Before accepting a gift from a patient, grateful relative or someone doing business or seeking to do business with the Trust, members of staff must consider carefully whether such an action can be
justified to the public or auditors.

1.3 Where such gifts can be justified, the value should not normally exceed £10 for gifts.

1.4 Gifts with a value greater than £10 should be reported to an individual member of Staff’s manager and its acceptance approved. The individual member of staff must then notify the Trust Board Secretary in writing of the gift. If acceptance is not
approved the gift must be returned.

1.7 All managers and staff must be aware that where a member of staff has received a gift valued at over £10 from a company or an individual who is a representative of a company, the member of
staff must not be placed in position where they could influence any business dealings with that Company. "

Do you have any information to show why the Chairman or the Trust Board were not asked for approval for this Hospitality?

Do you have information to show the reason this Hospitality was offered to Mr Adler from a contractor?

The following Trust Board minutes appear to show that Mr Adler had some role in the dealings with BBraun:

Thursday 2nd August 2007
Mr. Adler updated on the sterilisation of instruments with the supplier BBraun.. An escalation meeting has taken place with David Thorpe, CEO of BBraun Sterilog Ltd. BBraun have admitted problems and are now providing more resources to eradicate the problems

Thursday 4th October 2007
The problems continued [with BBraun], and the issue was then escalated to Chief Executive level both in the Trust and BBraun. The attached action plan has been developed and is being worked through.

17 December 2009
As the contract is in its third year, the Trust Board was asked to approve the order for the payment of services in 2009/10. The estimated annual cost was noted to be £2,030,000. Mr Adler advised that discussions are continuing with BBraun regarding the future viability of the contract, however dialogue was good.

Does the Chief Executive have a role outlined in the contract with BBraun?
Did Mr Adler meet with BBraun during firstly 2007/8 and secondly 2009/10?

Question 4
The FOI reply of the 7th September 2010 gave a figure of £2,471,035.74 for the 2009/10 non pan-Birmingham contract with BBraun.
Was the 2009/10 BBraun contract for £2,030,000 referred to in the Board minutes from the 17 December 2009, the same contract as in the FOI reply?
If so, what makes up the difference between these two figures?

Question 5
There was an increase of £280,000 in the non pan-Birmingham contract, from £2,471,035.74 in 2008/09 to £2,750,620.00 in 2009/10 an increase of 12%.
Do you have information to show why there was this increase in payment?

Question 6
What were the yearly instrumentation unavailability figures in each year from 2005/6 to 2009/10 for the Trust using the same approach the Trust uses in its Quality monitoring reports?
