We acknowledge receipt of your request and are processing it under the terms of the Freedom of Information Act 2000.

However, due to the ongoing CORONAVIRUS pandemic, the Trust is facing numerous challenges, including pressures in maintaining staffing levels. The Trust will endeavour to respond to your request for information that the Trust holds within the statutory 20-working-day period, however, this may not always be possible. As you will appreciate, the Trust is prioritising the delivery of healthcare and focusing its resources on making sure that service users are receiving the treatment and care needed. This means that staff who would usually assist with responding to information requests are focusing the majority of their time and attention to this in order to ensure that our service users are well looked after. Unfortunately, this may mean that there could be a delay in providing you with the information that you have requested. The Information Commissioner’s Office (ICO) is aware of these understandable delays and has stated that it will not penalise organisations, such as the Trust, that need to prioritise their resource within other areas or adapt their usual approach during this time.

I am writing to request an internal review of Cumbria, Northumberland, Tyne and Wear NHS Foundation Trust's handling of my FOI request 'Information about your dealings with Stonewall #DontSubmitToStonewall'.

1. Any application you made in 2019 or 2020 to be a “Stonewall Diversity Champion” or to be included on Stonewall’s “Workplace Equality Index,” including any attachments or appendices to those applications. Please redact personal details if necessary.

We joined Stonewall as a Diversity Champion in February 2019, we were offered a deal for membership through to 2022. We will be reviewing our membership at the start of 2022. We took part in the Workplace Equality Index for the first time in September 2019. Our submission was made online and there was not an option to produce a PDF copy of that submission. Our supporting evidence and where we have word copies of our submission for each question available are included in the attached zip file*.

2. Any feedback you received in 2019 or 2020 from Stonewall in relation to either application or programme.

The Feedback report for our September 2019 submission is the first attachment in this email

3. Any other communication you have received from Stonewall in 2019 or 2020 unless privileged or otherwise exempt from disclosure (but if you claim privilege or exemption in relation to any material, please say in broad terms what the material is and the basis on which you claim to be entitled to withhold it).

The only communication that we received from Stonewall during this period was discussion regarding the Written Feedback Report to our Workplace Equality Index Submission made in September, 2019. The LGBT+ Staff Network and the Equality and Diversity Lead meet with Stonewall on 7 th February 2020 to discuss. Trust Executive Directors met with Stonewall for a similar discussion on 5 th October, 2020.

4. Full details of any equality impact assessment you carried out connected with any of these applications (including any equality impact assessment carried out prior to an earlier application of the same kind, if no further assessment was done).

We have not conducted an impact assessment connected with our status as a Stonewall Diversity Champion or regarding our submission to the Workplace Equality Index. We are however reviewing our workforce policies following guidance from Stonewall. Any amendments to these policies will require an equality impact assessment.

5. Details of the total amount of money you paid to Stonewall (i) in 2019; (ii) in 2020, whether or not as payment for goods or services.

As stated in question 1 we joined Stonewall in 2019 on a three year membership deal at a cost of £6,000.

6. Whether you intend to continue your membership of any Stonewall scheme in the future, and if so which.

We will be making a submission to the Workplace Equality Index this year, we have yet to make decisions about Stonewall Diversity Champion membership beyond 2022, or participation in the Workplace Equality Index.

Two pieces of evidence that were in PDF form and contained names and photographs of members of staff could not be redacted and were therefore removed from the submission.

Stonewall membership includes tailored email and phone support and advice through a dedicated account manager, feedback & review of HR and other policies “for LGBT inclusion” by Stonewall staff, introductions to other “Diversity Champion” members and more.

So your responses to parts 2 & 3 of the request are not credible. Word copies of your submissions for each question of the WEI are missing from the attached zip file. Responses will have involved HR, training, employee LGBT network groups, and LGBT trade union representatives or groups so should be available for all questions. Employee Feedback Survey results, meeting notes for 7 Feb and 5 Oct 2020 and emails with yr Stonewall contacts are also missing.

I do not accept that you do not hold or have access to this information electronically and so can analyse and respond without exceeding the appropriate limit.

Public authorities should try to be as helpful and flexible as possible. When you review your response to my request, you may find there is a great deal of data. Please be aware that if this is the case, it is possible to comply with my request without incurring excessive costs by, for example, providing me with a list of the custodians (by job title; I do not need to know names) you believe to have been the recipients of communications requested under this request.

That, of course, would not exhaust your duty to provide me with advice and assistance: there may be other ways in which you can help me to refine my request so that it captures a representative picture of your dealings with Stonewall without exceeding the appropriate limit and answers the request properly.

3 year Stonewall Diversity Champion membership Feb 2019 - 2022 at cost of £6k. Workplace Equality Index for the first time in September 2019.

No impact assessment for either. Amendments to workforce policies being reviewed with “guidance from Stonewall” will require an equality impact assessment.

The ‘reasonable time period’ identified by the Information Commissioner for conducting such reviews is generally 20 working days.
