Dear Coventry City Council,

This is a request under the Freedom of Information Act 2000 (FOIA). Please provide any information that you hold answering to any of the following descriptions:

1. Any application you made in 2019 or 2020 to be a “Stonewall Diversity Champion” or to be included on Stonewall’s “Workplace Equality Index,” including any attachments or appendices to those applications. Please redact personal details if necessary.

2. Any feedback you received in 2019 or 2020 from Stonewall in relation to either application or programme.

3. Any other communication you have received from Stonewall in 2019 or 2020 unless privileged or otherwise exempt from disclosure (but if you claim privilege or exemption in relation to any material, please say in broad terms what the material is and the basis on which you claim to be entitled to withhold it).

4. Full details of any equality impact assessment you carried out connected with any of these applications (including any equality impact assessment carried out prior to an earlier application of the same kind, if no further assessment was done).

5. Details of the total amount of money you paid to Stonewall (i) in 2019; (ii) in 2020, whether or not as payment for goods or services.

6. Whether you intend to continue your membership of any Stonewall scheme in the future, and if so which.

Dear Information Governance,

You reply:
1. Any application you made in 2019 or 2020 to be a “Stonewall Diversity
Champion” or to be included on Stonewall’s “Workplace Equality Index,”
including any attachments or appendices to those applications. Please
redact personal details if necessary.

Coventry City Council has recently become a Stonewall Diversity Champion in
December 2020. Please see the attached documents.

Please note certain information has been redacted, removed, as it could be used to
identify the individuals involved.

Therefore, this information is exempt under section 40 (2) of the FOIA. This
exemption covers the personal data of third parties (anyone other than the
requester) where complying with the request would breach any of the principles in
the Data Protection Act.

This has been done as the Council considers that this information meets the
definition for personal data set out in Section 3(2) and 3(3) of the Data Protection Act
2018 ("DPA") as:

(2) "personal data means any information relating to an identified or identifiable living
individual (subject to subsection (14)(c))”

(3) “Identifiable living individual” means a living individual who can be identified,
directly or
indirectly, in particular by reference to –
(a) an identifier such as a name, an identification number, location data or an
online identifier, or
(b) one or more factors specific to the physical, physiological, genetic, mental,
economic, cultural or social identity of the individual.”

The Council thus considers that the requested information is caught by the
exemption to disclosure contained in Section 40 (2) of the FOI Act and the related
first condition of Section 40 (3).

This is an absolute exemption and there is therefore no requirement to consider the
public interest.

2. Any feedback you received in 2019 or 2020 from Stonewall in relation to
either application or programme.

The only feedback received was a thank you for the application and confirmation of
acceptance. This is in the documentation provided in Question 1.

3. Any other communication you have received from Stonewall in 2019 or
2020 unless privileged or otherwise exempt from disclosure (but if you
claim privilege or exemption in relation to any material, please say in broad
terms what the material is and the basis on which you claim to be entitled
to withhold it).

4. Full details of any equality impact assessment you carried out connected
with any of these applications (including any equality impact assessment
carried out prior to an earlier application of the same kind, if no further
assessment was done).

No equality impact assessments were carried out connected with the applications.

5. Details of the total amount of money you paid to Stonewall (i) in 2019; (ii) in
2020, whether or not as payment for goods or services.

There was a payment of £2.5k as part of the membership agreement in 2020.

6. Whether you intend to continue your membership of any Stonewall scheme
in the future, and if so which.

No decisions have been made at the present time.
