Dear King George V College,

This request follows legal and mandatory legislation under the European Performance of Buildings Directive and specifically TM44 Air Conditioning Assessments certification. Your Air Conditioning Assessments Certificates should be readily available at all times and be lodged on the government Landmark database. Failure to have appropriate Certificates will be subject to fines of £300 per building, each week.

Q. It is a legal requirement that you hold valid TM44 Air Conditioning Assessments if any building has a total of more than 12kw of air conditioning present. Certificates are valid from 5 years of the issue date. Have you undertaken a TM44 Air Conditioning Assessments?

Thank you for your Freedom of Information request.

I am sending you (attached) a copy of the College’s Freedom of Information Policy. The College, as set out in its policy, does require a small fee of £7.50 to cover administration costs for each Freedom of Information request made.

For clarification, the College aims to meet Freedom of Information requests within five working days, and will do everything possible to adhere to the Government’s 20 working day target. However, as per the legislation, the period between the transmission of this e-mail and receipt of the appropriate fee is not included in the 20 working day calculation.

If you wish to proceed with your Freedom of Information request, please could you arrange for payment of the administration fee.

Dear Swift, Ian - Vice Principal/Deputy Chief Executive - Curriculum & Quality,

I think your policy does not match the express provisions of the Freedom of Information Act. I ask that you review the statute and qualify why you are applying a fee in this instance?

The Act does describe a prescribed timescale and resource allocation which benchmarks when a fee is applicable.

Given that this environmental information request centres on legal documentation. You should have it easily accessible and available on demand, therefore removing the fee exception described in the act.

I am treating this additional dialogue within the 20 day statutory time scale as allowed by the act.
