Please be advised that St Andrew's Healthcare are responsible for commissioning advocacy arrangements for patients sectioned under the Mental Health Act at St Andrew's Hospitals and therefore, North Northamptonshire Council would not be able to provide the information requested as it is not a service we are responsible for commissioning.

The Mental Health Act is clear. (chapter four) It is stated the local authority is responsible for providing IMHA advocacy, not private providers. This is in order to keep the advocacy Independant.

Berrywood patients are given the service commissioned by The Local Authority, yet patients unfortunate enough to be placed in private hospital are not.

Please point out the part of the act which removes the responsibility of Northamptonshire council to private patients

Independent Mental Health Advocates: conditions
6.—(1) A person may not act as an IMHA unless the conditions specified in paragraph (2) are satisfied.

(2) Those conditions are that the person referred to in paragraph (1)—

(a)has appropriate experience or training or an appropriate combination of experience and training;

(b)is a person of integrity and good character;

(c)is able to act independently of any person who is professionally concerned with the qualifying patient’s medical treatment; and

(d)is able to act independently of any person who requests that person to visit or interview the qualifying patient.

Principle of independence [section 130A(4)] 4.7 When making arrangements for advocacy, a local authority must have regard to the principle that advocates should, so far as is practicable, be independent of the professionals currently involved in the medical treatment of the patient they are helping. The Act describes this as being independent of ‘any person who is professionally concerned with the patient’s treatment’. 4.8 In this context, people are not to be considered to be professionally concerned with a patient’s treatment if their only involvement with that treatment is acting as an advocate for the patient in connection with the treatment. Advocate here includes advocates under the Act, as well as independent mental capacity advocates (IMCAs) helping people under the Mental Capacity Act 2005,34 and anyone else acting as a patient’s representative. 4.9 The Secretary of State may make regulations about the criteria which people must meet to be eligible to be IMHAs.

Duty to arrange advocacy services [section 130A] 4.2 A local authority is required to make arrangements which it thinks reasonable for IMHAs to be available to help qualifying patients for whom the local authority is responsible

4.6 A local authority is responsible for a qualifying patient if: • the patient is liable to be detained in the local authority’s area • the patient is subject to the guardianship of the local authority or a person who lives in the local authority’s area • the patient is on a CTO and the responsible hospital (the hospital whose managers have responsibilities in relation to the patient) is in the local authority’s area, or • in the case of a patient described in 4.4, the local authority is nominated as being responsible for arranging the patient’s access to the services of an independent mental health advocate (IMHA) by: o the patient, if the patient has capacity or is competent to nominate the local authority o or if the patient lacks such capacity or competence, the patient’s attorney or deputy, Court of Protection, or a person engaged in caring for the patient or interested in his welfare.

If you are satisfied with the independance, then could you please share what tests, or monitoring you have done, to ensure this, or to reach or your satisfaction.

Could you please also inform me if the patients at st andrew's in northampton are aware of their right to contact an IMHA from voiceability, is there posters for both services on the ward?

Why do the ward phones on each ward only ring through to the Together IMHA phone line.

Is there a framework you use to be satisfied to discharge your responsibility under the mental health act, if so could you please share this.

I write in relation to your below email; and must first offer our
apologies for the delay in response. This has been as a result of the
Council’s Commissioning Quality & Outcomes team needing to liaise directly
with St Andrew’s in relation to the details of your request.

 

Further to their meeting, a representative for the hospital has advised
the Council of the following:

 

‘The IMHA contract delivered by Together is commissioned by St Andrew's
and the monitoring processes of this contract are overseen by St Andrew's.
Therefore all enquires in relation to this should be put to St Andrew's
Hospital directly.    

 

The VoiceAbility contract is commissioned by both North and West
Northamptonshire Councils and the service is available to all residents of
Northamptonshire. This meets our responsibilities under The Care Act.

 

Work is currently underway to enable the patients of St Andrew's to access
the VoiceAbility service, in addition to the service already provided by
St Andrew's’.

 

Further to this statement, and having sought confirmation from the
Council’s Commissioning Quality & Outcomes Manager, I can confirm that the
requested information is not held by North Northamptonshire Council.

Dear Mr Kinder

 

I write in relation to your below email; and must first offer our
apologies for the delay in response. This has been as a result of the
Council’s Commissioning Quality & Outcomes team needing to liaise directly
with St Andrew’s in relation to the details of your request.

 

Further to their meeting, a representative for the hospital has advised
the Council of the following:

 

‘The IMHA contract delivered by Together is commissioned by St Andrew's
and the monitoring processes of this contract are overseen by St Andrew's.
Therefore all enquires in relation to this should be put to St Andrew's
Hospital directly.    

 

The VoiceAbility contract is commissioned by both North and West
Northamptonshire Councils and the service is available to all residents of
Northamptonshire. This meets our responsibilities under The Care Act.

 

Work is currently underway to enable the patients of St Andrew's to access
the VoiceAbility service, in addition to the service already provided by
St Andrew's’.

 

Further to this statement, and having sought confirmation from the
Council’s Commissioning Quality & Outcomes Manager, I can confirm that the
requested information is not held by North Northamptonshire Council.

 

Should you wish to raise any direct request with the hospital; or if you
have any additional enquiries in relation to this existing matter, you are
able to contact their Head of Patient and Carer Engagement, PALs and
Complaints, Nicola Lintott, via email to [2][email address], as

Hello,

You stated that as the IMHA's are employed by Together that they are
independent of anyone involved in the care of patients at St Andrew's. The
contract is monitored by the same person who is in charge of the
complaints department. That is involved with their care.

If you are satisfied with the independance, then could you please share
what tests, or monitoring you have done, to ensure this, or to reach or
your satisfaction.

Could you please also inform me if the patients at st andrew's in
northampton are aware of their right to contact an IMHA from voiceability,
is there posters for both services on the ward?

Why do the ward phones on each ward only ring through to the Together IMHA
phone line.

Is there a framework you use to be satisfied to discharge your
responsibility under the mental health act, if so could you please share
this.
