Dear Scottish Borders Council,

I hear by request the following information or information that would pertain to the following questions under HM Freedom of Information (Scotland) Act 2002:

Per regards data (as defined by HM Data Protection Act 1998) of a subject that the council may hold, under what circumstances may the data be shared with the following organisations against the subject(s) consent or without informing the subject(s) of the data that there data is being shared:

1. Central Borders Citizens Advice Bureau.

2. Borders Independent Advocacy Service.

3. Borders Aspergers and Autism Group Support.

Under what circumstances may data of a data subject(s) be shared with the council by the above organisations against the data subject(s) consent or out with there knowledge.

Finally, how many requests during 2010-2013 have been made by these organisations to the council concerning data subjects out with or against the consent or knowledge of the data subject(s) to whom the data they seek may or may not pertain ? And how many requests by council to these organisations have been made for data of subject(s) between 2010-2013 out with or against the consent or knowledge of the subject(s) of whom the sought data may or may not pertain ?

Dear Oysterman

Further to your request for information under the Freedom of Information
(Scotland) Act 2002 relating to the above I am now able to respond.

 

I can advise that Scottish Borders Council would not share personal data
with the organisations you refer to without the data subjects’ consents 
and I can also confirm that if any requests were made by those
organisations then we would again have to have the data subjects’
consents.  This would either be written or verbal.  As we do not hold this
information it is therefore exempt under Section 17 of FOISA.

 

I hope you are happy with the information provided but have to advise that
you have a right to request a review within 40 working days of receipt of
this email.  You should either e-mail [1][Scottish Borders Council request email] or write
to the Data Compliance Officer, Scottish Borders Council, Council HQ,
Newtown St.Boswells TD6 0SA.

 

If after the Council’s FOI Advice Group have considered your review and
you are still not happy with the decision you then have a right to appeal
to the Office of the Scottish Information Commissioner, Kinburn Castle,
Doubledykes Road, St.Andrews, fife KY16 9DS.

Dear Scottish Borders Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Scottish Borders Council's handling of my FOI request 'Illegal data trafficking'.

I request the council review its answer. I believe there may have been requests made and information shared with these organisations by the council or vice-versa under social work or care excemptions within the act. I also believe that if this has not happened request have been made under such grounds. Therefore I ask the council to reconsider its answer in light of this and if any of the above is true them to supply me with the information.
