Dear West Berkshire Council,

1 Following the ICO Consensual Data Protection Audit of West a Berkshire Council in 2013, please could you provide a copy of the follow up reports ( full report and Executive summary).

2 Please could you also provide links to minutes where the original audit report and the follow up were presented to the Council and/or sub-committees of the Council.

3 Finally, the ICO website indicates that consensual audits can sometimes cover FOI. Were FOI issues covered during either ICO audit? If so, please provide the reports.

Request for information: ICO Audit Follow up

 

In questions 1 & 2 of your request you have asked for a copy of the follow
up report and a link to any minutes where this report or the original
report was presented to Council following the Data Protection Audit that
was carried out by the ICO in 2013.

I can confirm that the Council does not hold any information to respond to
question 1 & 2 of your Freedom of Information request.

 

You have also asked whether FOI issues were covered during the ICO audit.
I can confirm that the review was limited to Data Protection only;
therefore, no reports are held.

 

If you are unhappy with the way your request has been handled, you may ask

I can no longer find the Executive Summary originally posted on the ICO web site, nor can I locate details of any follow up.

Looks like the executive summary has been archived. See:

After an audit, the public body has to give their agreement for the executive summary to be published. it's kept on the ICO website for one year. See:

I guess the executive summaries are moved to the national archives site after 1 year.

I'm intending to follow up on this as it highlights:

A) lack of segregation of duties within the Council ( same officer/manager serves the scrutiny committee, complaints, FOI and DPA )
B) lack of Councillor awareness/ oversightof information rights responsibilities
C) the lack of power ( or willingness to use it) of the ICO.

The issue of segregation of duties is very important. Mr Lowes control is like the dead hand on FOI/, EIS and complaints.

What is also interesting is that Mr Lowe is also the head of the local Unison branch so the man responsible for dealing with complaints against West Berks Staff is the same person who as a union leader is charged with defending these staff against claims they have not acted properly
