We're waiting for Kerry Radley to read recent responses and update the status.

Dear Kerry

Thank you for your recent correspondence, which appears to relate to a
previous request you submitted to Broadland District Council (our ref:
BFOI 20-533). I can advise that the response to this request has already
been reviewed internally and all correspondence relating to this is on the
WhatDoTheyKnow platform, through the link you provided. We are unable to
conduct a further internal review and as advised on 4 March 2021: ”If you
are still dissatisfied, you can contact the Information Commissioner and I
show below the contact details for your information: Office of the
Information Commissioner, Wycliffe House, Water Lane, Wilmslow, Cheshire
SK9 5AF.  Tel: 0303 123 1113.  Website: [1]http://www.ico.org.uk.” There
is no outstanding action to provide the data supplied under this FOI to
you unredacted – we have disclosed further information that the internal
review found should be disclosed – this was supplied to you on 4 March
2021.

Further to the above, it also appears that you have requested an update in
relation to the information you previously requested; our reference BFOI
20-533. This request was received on 22 December 2020, therefore your new
request appears to relate to information since 22 December 2020. This
request related to: “any correspondence within Broadland District Council
(staff) and to and from Salhouse Parish Council and all Councillors or
Norfolk and South Norfolk Councils involving Kerry Radley’s CPN and ACV or
Radley’s at 82b Lowers Street, Salhouse NR13 6HD.” I also note the follow
up to your most recent request that refers to councillor’s private email
addresses. For the avoidance of doubt, I would be grateful if you could
confirm that my understanding of your new request is correct and provide
full details of your businesses and properties that the FOI request
references. The time we have to comply with your new request (our ref:
22-151) will be paused until we receive further clarification and
confirmation that the above is correct. If I have misinterpreted your
request, please provide further details of the information you are
requesting – including date ranges relating to the data requested, if
appropriate. Currently, the date by which we have to comply is 29 April
2022, however this may change depending on when we hear back from you. I
will notify you if this is the case and provide a new deadline date. In
addition, you requested an internal review on 30 March 2022 of the FOI
request you submitted on 30 March 2022, which has not yet been considered
/ responded to. Your right to an internal review will begin once we have
responded to your request, as detailed above.

Alternatively, you may have intended to submit a Subject Access Request

Dear FOI (BDC),
New data has come to light that you have still not released. You know the ICO have found you guilty of withholding, deleting and redacting my data. So to be clear I am requesting all my missing data which includes private emails concerning myself and property. Which I know exists because I have it in my possession. The hand written notes for the CPN. Again I know this exists. As it appeared on Cllr Nudds business facebook page a few weeks ago. This also begs the question why BDC are sharing private court documents with members of the public and pretending they do not exist. I also want data up to this date that has not yet been released. SPC have said there was correspondence with BDC about my ACV from June last year which I want to see and anything from police, or planning. Look everything I am missing. Remember the advise the ICO have given you. Please comply with your own data policy. Please send a copy of your internal review and correspondence with the ICO.

Thank you for your further correspondence below. I am still unclear
regarding what information you are trying to access and whether you would
like to access information under an FOI or SAR request. To assist you, it
may help if we outline a few things, which we hope will set out our
processes a little more clearly for you:

 

Freedom of Information Act Request: these requests relate to recorded
information held and entitles the public to access documents / recorded
information held at the time of a request. Under FOI, a requester’s
personal data is exempt from disclosure (this would be provided under a
SAR), as any information released under the FOI Act is disclosed as if it
were being released to the world at large, not just the requester. Other
exemptions may apply to prevent disclosure and we always explain why these
are applied when the need arises. We have 20 working-days to comply with a
request, once any required clarification is received.

 

Subject Access Request: these requests relate to the right of individuals
to obtain their personal data. Personal data can relate to more than one
person, therefore often information that is requested will relate to a
requester and third party/ies. If this is the case, we will consider any
consent provided to share the data; if it is reasonable to disclose
without consent; and also any duty of confidence. Other exemptions may
apply, which we would explain and provide reasons for. We have one
calendar month to respond to a SAR request. Requesters should submit a SAR
via a private channel (such as a direct email to the Council), rather than
this public site which is intended for FOI requests).

 

In light of the above, may I ask that you consider this and provide a
clear request that is not too wide in scope, which focusses on the
specific data that you would like to access. We receive over 500 requests
annually and your further clarification will ensure that public resources
are used appropriately and officers are not distracted from providing core
services. We want to be in a position to be able to assist you and as
such, if you intend to submit a new FOI request please outline the
following:

 

• clearly outline the scope of your new request, or advise if you are
requesting an update for information previously requested (quoting the
reference number provided to you previously)
• outline the date ranges involved relating to information requested.
• provide full details of the “properties” and “businesses” you own.

 

If you wish to submit a SAR, please email the Council directly, via the

As above, please outline clearly the scope of the request and provide
relevant details. Moving forward, if you continue to correspond over this
platform and request data, I will treat any further requests under the FOI

Please note that all previous FOI requests are closed, as outlined in one
of my recent emails to you. All previous FOI requests have been reviewed
internally and there are no outstanding actions for the council to comply
with in terms of supplying data previously requested.  You have made
accusations that further information has come to light that has not been
disclosed to you and you have referred to “missing data”, however I am
unclear what you are referring to and the Council can only provide
information which it holds and which it is able to release (if no
exemptions apply).
