Dear Sir or Madam,

In the 60 per cent of the about 130,000 claims to the LGO where maladministration was not identified as having occurred over the last ten years.

And as you state: As you state: 'A failure to consider Human Rights Act issues has been found to amount to maladministration by the Ombudsman.'

On how many occasions has the LGO identified that a Council has breached equalities legislation and the European Convention of Human Rights firstly in their decision letters and other correspondence with Council's.

Please list by Council the number of occasions over the last ten years that the LGO has identified a violation of Human Rights and Equalities legislation by each Council in England - by article right and equalities catagorsation (i.e. race, women, etc).

Please further provide any guidance provided to the Human Rights and Equalities Commission (and their predecessors) by the LGO and or CLAE on how they should interpret a finding of maladministration

Dear Hilary Pook,

According to Local settlements the figure must be much higher.. About five per cent of the decisions related to Camden over the same period identify abuse of equalities and/or human rights legislation by the Council.

Please would you also provide the data including local settlements, outside jurisdiction, premature and ombudsman's discretion. The fact that the LGO might choose to discontinue an investigation despite abuse of Human Rights and Equalities Legislation being apparent is very much the issue. You will be aware that the Camden local settlements all appear to have disagreed with the LGO's decision to catagorise their complaints as LS rather than issue an MI report
