Hoylake Open 2014 Traffic Management Plans

We're waiting for P Unitt to read recent responses and update the status.

Dear Wirral Metropolitan Borough Council,

Please can you provide the full traffic management plans for
Hoylake during the Open 2014. Please include the following
information.

- Plans shown during public participation including drafts and
final published plans. This should include drawing and visual
diagrams of planed layouts, in particular that of Station Road in
Hoylake.
- Any changes that were made up to and during the event and who was
responsible for any changes and reasons for changes including what
public participation was done (if any)
- Impact assessment plans for traffic management of the area and in
particular Station Road
- Any information and communications made or sent by any council
staff/ councillors regarding Station Road/Hoylake Parish Church or
businesses and traffic management in the area during the event
(this should include emails/notes/letters or any other
communication)
- Role of the "Wirral Ambassadors" in traffic management, including
instructions given to them in regards to traffic management and use
of footpaths/bridges

I would like all of this information available in electronic format.

Regulation 6 of the Environmental Information Regulation, (EIR) states

 

6. (1) Where an applicant requests that the information be made available
in a particular form or format, a public authority shall make it so
available, unless—

 

(a)   it is reasonable for it to make the information available in another
form or format

 

The Information Commissioner’s Officer has published guidance on this
subject, stating

 

10. In our view, the requester must express their preference as to how
they want the information at the same time they make their request.

 

In your initial enquiry you stated that you would like the information
‘available in electronic format’. As has been stated, the Council is happy
to fulfil this request by posting a USB memory stick to you. We would
merely require your address. Though the legislation allows a public
authority to issue a fees notice to cover the cost of any disbursements
(i.e. postage, cost of materials, etc), the Council will not levy a charge
in this instance.

 

The information requested consists of 233 individual files, with a
combined file size which would exceed the maximum limit able to be
emailed. If the information were to be hosted online, either on the
Council’s website or via an external file hosting service, this would
require each file to be uploaded separately. This would be an extremely
labour-intensive exercise, and one which the Council feels would not be
reasonably practicable to carry out.

 

The Council is therefore of the opinion that they have fulfilled their
duties under the Regulations.

 

You have the right under Regulation 11 to make representations to the
authority if you are believe that the Council has failed to comply with a
requirement of the Regulations. This should be sent to
[1][Wirral Borough Council request email] and it will be allocated to an
independent officer to review, which will be completed within 40 working
days.

 

If you are dissatisfied with the result of your review, you also have the
right to complain to the Information Commissioner, whose address is

Dear Tracy,

I am merely trying to make this process easier and less burdensome for you.

Placing the files on your web server is a much easier task than putting on USB stick and sending it via post. Not to mention much cheaper.

In order to put the file on the web server you can compress the folder with all the files on it into one single .zip file. If you are unfamiliar with the process then there will be someone in your IT department who can help you. Doing it this way shall avoid unnecessary costs for the council which I am aware the council are trying to achieve.

I have spoken to the ICO who have already confirmed that requesting you to upload it to your server or file hosting service is a reasonable request considering I have asked for it in electronic format.

Council’s response to be reviewed.

 

As stated, the reviews procedure under R.11 of the Environmental

The internal review process is carried out to establish whether the
Council has appropriately responded to a request for information. As
explained on the Information Commissioner's website [1]here, the
‘complaints [internal review] procedure is triggered whenever a requester
expresses dissatisfaction with the outcome’.

 

The Council’s response was that the information could be communicated to
you on a USB memory stick upon receipt of a postal address. The review
will assess whether this addressed your original request.

 

The Council is not delaying the release of this information. The option to
receive the memory stick remains open to you, should you wish to receive
it.
