Dear Mr Chapman

Case 332735

Further to your complaint received on 7 August 2018 I have been asked to
undertake a review of the response to your request for information under
the Environmental Information Regulations 2004 request ref. 18190485.

I have considered your request, the original response and I have
undertaken further enquiries with the department concerned.

Unfortunately there was an error within the original response being the
size of the land available for residential development at Collaton St Mary
which is 113,800m² not the 19,829m² stated.

In addition I am able to confirm to you that the total land identified
amounts to 5 sites across Torbay and it is considered that these sites
could reasonably deliver residential development in the short term.

Further information as to available land can be found online at
[1]http://www.torbay.gov.uk/council/policie...

The Public Interest Test

As you have been provided with the requested information I have not had to
consider the Public Interest Test.

Conclusion

I am sorry for the error within our original response.  As the information
provided was incorrect I will uphold your complaint.

If you remain unhappy with the outcome of your internal review, you are
entitled to refer your complaint to the Information Commissioner's Office
(ICO) for a decision.

The ICO can be contacted at:
Information Commissioner's Office
