requesting that the Metropolitan Police Service (MPS) review its response
to your request for information received by the MPS on  27th January 2013

Unfortunatly the law has not been complied with as I have not received the
information requested by the 20 day deadline.

Further the information requested is so simple and specific that as a tax
payer I am horrified that you cannot locate it within 1 working day let
alone in excess of 20.

DECISION

The Metropolitan Police Service (MPS) acknowledges the delay to you
receiving a response.

Reason for decision

The review takes note of your comment ‘the law has not been complied with
as I have not received the information requested by the 20 day deadline.’
In this regard I can advise you that the statutory time limit for
responding to a Freedom of Information Act request is set out in Section
10(1) of the Freedom of Information Act 2000 (FoIA) which states that a
public authority must comply with section1 (1) promptly and in any event
not later than the twentieth working day following the date of receipt.
 Therefore, a public authority must inform the applicant in writing
whether it holds the information requested and if so, communicate that
information to the applicant, promptly, but not later than 20 working days
after receipt of the request.

Your request for information was received by the MPS on the 27th January
2013 and therefore a response should have been sent by the 22nd February
2013.  

In this regard the review gives attention to the MPS letter sent to you on
the 27th February 2013 which states ‘I am sorry to inform you that we have
not been able to complete our response to your request by the date
originally stated, as we are currently trying to establish what
information the MPS holds, if any, and whether it can be retrieved within
the cost threshold as laid out under Section 12 of the Freedom of
Information Act (the Act).’ The review is also aware that an amended
response date of 22nd March 2013 has been provided.  However, the MPS
acknowledges that this delay letter was sent outside the 20 working days
and apologises for this delay.

In this respect I would like to advise you of the Information
Commissioner’s Office Good Practice guideline which states ‘The FOIA
requires public authorities to comply with requests for information within
20 working days following receipt of the request’.  I can confirm that in
this instance a failure to respond to your request within the time limit
is a breach of section 10(1) of the Act.

The review also acknowledges your comment ‘I am horrified that you cannot
locate it within 1 working day let alone in excess of 20.’ and can advise
you that I have contacted the relevant unit dealing with your request and
can confirm the case is currently ongoing.

As a response to your request is currently outstanding, I am unable to
complete a full internal review in relation to your request.  However,
should you be dissatisfied with the MPS response to your request, you
would still be entitled to request an internal review in relation to the
decision.

I would like to take this opportunity to apologise for the delay you have
experienced and for any inconvenience caused by our failure to process
your request correctly.  I hope to reassure you that the MPS takes
compliance with the Act very seriously and is working hard to promote good
practice in regard to the processing of requests.
