Further to your recent request for information, ref 20180808-00046-1, can
you please provide further clarification.

 

 

The Government did (prior to 2014) make arrangements under which local
authorities could seek funding assistance to secure the remediation of
sites which were defined as 'contaminated' under Part 2A of the
Environmental Protection Act (EPA) 1990.

 

However, the definition of 'contaminated land' in the EPA is substantially
different to that of 'brownfield land' (which is in annex 2 of the
National Planning Policy Framework, most recently updated in July 2018). 
This means that many sites which are brownfield may not be contaminated
and vice versa.   We are aware of no government grant regimes which have
operated since 2010 which are specifically and solely aimed at funding 
the 'remediation' of 'brownfield' sites.   

 

Does your enquiry relate to the funding concerning Part 2A sites or to
another government funding programme?  If the latter could you please
specify the nature of this?  

 

Please also note that the information sought appears to fall within the
scope of the Environmental Information Regulations 2004.  This means that
– in accordance with its Freedom of Information Policy - the Council is
likely to make a charge to cover the costs of staff time to supply the

Government Regulations, to qualify for inclusion on the Register,
sites must satisfy the following criteria:

a) the land has an area of at least 0.25 hectares or is capable of

b) the land is suitable for residential development;

c) the land is available for residential development; and

d) residential development of the land is achievable.

 

* The Council has made 3 applications to secure the remediation of sites
defined as contaminated land between 2009/10 and 2014/15.

The three sites are centred approximately at the following co-ordinates;

 

X: 395342 Y: 352008

X: 395297 Y: 351976

X: 352413 Y 395061

 

The first two are residential properties and we did not apply for funding
to remediate as we considered that we were precluded from carrying out
remediation under sections 78E(4) and (5) of Part 2A of the Environmental
Protection Act 1990.

 

The third is an area of public open space that we did not apply for
funding to remediate as it has been addressed instead via a management
plan.
