Housing Development at the Carleton Clinic Carlisle
Dear Cumbria County Council,
I refer to planning applications reference 15/0918 and 19/0459 and the associated section 106 agreements between Cumbria County Council, Carlisle City Council, the NHS trust and the two developers Taylor Wimpey and Homes England respectively and would be grateful if you could provide information under Freedom of Information, that explains why consideration of both applications overlooked the fact that Cumwhinton Drive is, at the points of access to these developments, a private road and so the developments are in breach of the Cumbria Development Design Guide, which requires developments greater than five units to be served from a publicly adopted highway.
The private road owned by the NHS is now in an appalling state of disrepair and serves around 180 new houses plus the Carleton Clinic and acts as a distributor road for Parkland Village and beyond, yet this was not seen as something that needed to be addressed by either developer before houses were occupied using planning conditions or a section 106.
Instead, contributions were requested and made to off-site works at Sewell Lane, the proposed southern bypass and signals at London Road and Cumwhinton Road.

Thank you for your request for information regarding Housing Development
at the Carleton Clinic Carlisle, which was received on 09/11/2022.
The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 07/12/2022.
Subject to the information not being exempt or containing any references
to third parties.
The council will, as a matter of routine make information available in
electronic format. Where it is not practical to do this information will
be provided in hard copy (paper). If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.
The Environmental Information Regulations 2004 define a number of
exemptions/exceptions which may prevent information being released to you
automatically. The council will make an assessment about the application
of any exemptions/exceptions and issue you with a decision letter, which
will include details of your right to appeal.
If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.
In accordance with the council's Charging Policy a fee may be charged for
supplying information. If a fee is payable you will be issued with a fees
notice. The applicable fee must be paid in full before the information is
processed and released. The statutory time limit for responses is
suspended until the council has received and processed your payment. If
payment is not received within three months of issuing the fees notice
your request will be closed.

I am writing to request an internal review of Cumbria County Council's handling of my FOI request 'Housing Development at the Carleton Clinic Carlisle'.
I note that you have not confirmed or denied whether the authority holds this information, and have not applied an exemption that would remove this obligation.
As you may be aware, Section 1(1) of the FOI Act (https://www.legislation.gov.uk/ukpga/200...) states that "Any person making a request for information to a public authority is entitled to be informed in writing by the public authority whether it holds information of the description specified in the request".
I would be grateful if you could clarify whether or not this information is held, or specify which exemption of the duty to confirm or deny you are applying.
If it helps, please could you confirm why the Local Highway Authority did not recommend the Local Planning Authority include a condition that the applicant brought the private road up to an adoptable standard before the housing development took place and if not why not? Why was the existence of a private road overlooked?
