Dear Ms Tomkins,

The Council has received a Freedom of Information request from you below,
of course the Benefits department know the current housing benefit
regulations in respect of overnight carers and calculations of housing
benefit entitlement is dealt in accordance with the regulations and
current case law. If a claimant does not agree with a decision there is a
prescribed appeal process the claimant needs to follow.

If the claimant does not the proper appeal process then decision cannot be
reviewed or correctly if they are wrong in law.

 

You have had a number of telephone conversations with benefit staff
including the Benefit Manager (Mr N Allen ) and his senior officer

(Mr  O Kole-Emmanuel) who have tried to explain what is required to be
supplied to make a proper decision and have evidence to validate any
decisions. They have also put this in writing to you.

 

You asked to speak to me as I am the line manager of the Benefit Manager
and as per our telephone I explained I am responsibly for a number of
sections in the Council (not just Benefits), but I do not assess benefit
claims, I certainly don’t have the expert knowledge required regarding the
complex case law  & regulations surrounding the bedroom tax and over night
carers.

I informed you that Mr Kole-Emmanuel has sent you a letter yesterday
(dated 3^rd May 2018), but you were adamant in our telephone call that you
had supplied everything required. I explained the appeals process to you
and stated you can make an appeal within one month of any decision letter
(This is a letter confirming your awards of Housing Benefit).

I spoke to Mr Kole-Emmanuel after our telephone conversation and he has
made a decision based on the information you have supplied and sent
another letter to your dated 4^th MAY 2018 which you should receive early
next week. If you do not agree with his decision  then the last paragraph
in his letter states the course of action you need to follow.

 

Staff are not trying to make things difficult for your but they are
required to assess claims in accordance with the law and must justify
decisions by having documentary evidence to support these. Without the
required evidence decisions cannot be made.

 

Please read Mr Kole-Emmanuel’s letter and following the course of actions
stated if you do not agree with the decision.

I find it very strange that the person who is dealing with this does not know the Regulations surrounding the Bedroom Tax. In particular to a room for an overnight carer!! They SHOULD know, if they are dealing with such requests. It is clearly written in the Housing Benefit regulations, after all. They need to read them.
So, they can access what information, they as a council need. And not to release, misleading or incorrect information.
It is up to the council to decide and they should be capable of making such a decision, once they have all the information they require. Rather, than wasting the councils money to go to a tribunal, for a decision, they could make themselves.
