1. Details of your policies for staff in relation to the giving and receiving of gifts, hospitality and the like.

2. Please provide details of the disciplinary measures in place to address any breaches of these policies.

3. Please provide details of any and all cases in which staff have breached the rules in relation to gifts, hospitality and the like since 2012. In each case what was the breach, what was the position of the staff member, and what action was taken?

4. Unless addressed through your answers to the questions above, can you confirm that no member of Council staff has accepted free or subsidised tickets for any professional sporting events within the past 5 years from any external party. This includes parties with whom the Council has, or has had, a financial relationship. If this has occurred, please provide full details.

There are 8 sporting event registered in the Officer’s Gift and
Hospitality Register all from 2012.  As stated in answer 1‘An invitation
to join other company guests as Council representatives at sponsored
events, cultural, sporting or other public occasions’ is seen as an
acceptable type of hospitality.  

 

 

 

FREEDOM OF INFORMATION ACT 2000 – Someone else’s personal data

 

Crawley Borough Council has considered your request and has not provided
you with information relating to private individuals who are below third
tier management level.  This decision was taken with regard to the
following section of the Freedom of Information Act 2000.

 

Section 40(2) of the Freedom of Information Act 2000

 

Section 40(2) provides that information is exempt if:

 

If one of two conditions is met. These conditions are as follows:

 

First condition

 

Disclosure of the information to a member of the public otherwise than
under FOIA would contravene:

 

any of the data protection principles (section 40(3)(a)(i)), or

A DPA section 10 notice (section 40(3)(a)(ii)).

 

Second condition

 

The information is exempt from the subject access right by virtue of an
exemption in the DPA (section 40(4)).

 

In this instance your request for the personal information belonging to a
third party would be in direct contravention of Principle 1 under Section
40 (3)(a)(i) of the Data Protection Act 1998.
