Horse DNA on prisoners' food

Dear Ministry of Justice,

Following on from the discovery of horse/donkey DNA in many beef products could you please tell me:

1) Have any checks been made on food given to prisoners?

2) Have prisoners been known to have been fed with beef tainted with horse/donkey meat?

3) Have prisoners been known to have been fed with beef tainted with pork?

If any of the answers above are yes

1) could you please tell me what products were affected and which establishments were likely to have been supplied with the tainted food.

2) What has been done to rectify the situation?

3) What information has been given to prisoners?

4) From which suppliers has prison beef products been sourced?

If no checks have been made could you tell me why not?

Thank you for your e-mail, I am writing to advise you that your enquiry
does not fall under the Freedom of Information regime and will be treated
by the department as Official Correspondence.
 
It may be helpful if I explain that the Freedom of Information Act (2000)
gives individuals and organisations the right of access to all types of
recorded information held, at the time the request is received, by public
authorities such as the Ministry of Justice (MoJ). Section 84 of the Act
states that in order for a request for information to be handled as a
Freedom of Information (FOI) request, it must be for recorded information.
For example, a Freedom of Information request would be for a copy of a
policy, rather than an explanation as to why we have that policy in place.
On occasion, the Ministry of Justice receives requests that do not ask for
recorded information, but ask more general questions about, for example, a
policy, opinion or a decision.
 
Since you are asking for confirmation on the checks on food products and
if Prisoners are aware if any horse DNA has been found in their food this
will be dealt with as Official Correspondence and you can expect a
response from the appropriate area of the department.

It is very interesting that the MoJ maintain this is not covered by Freedom of Information Act since one would have thought that any testing etc. would be recorded and therefore meet the stated criteria for FoIA. A reasonable person might also expect that records would be kept in case of, for instance, a claim by a religious group that their food rules might have been compromised - if only to provide evidence that this was not the case.

Thank you for your quick response. I am surprised that the MoJ has no records of food testing or food testing results for prisoners' food - which would then meet your stated criteria. I have added an annotation to my request: 'It is very interesting that the MoJ maintain this is not covered by Freedom of Information Act since one would have thought that any testing etc. would be recorded and therefore meet the stated criteria for FoIA. Following on from my previous reply. Suppose I say;

Please provide me with copies of all reports and testing of food supplied to prisoners in relation to contamination by horsemeat or pork.

Please provide me with a list of suppliers of beef products to the Prison Service.

Please provide me with a list of establishments where it has been shown that beef products have been contaminated with either horsemeat or pork.

As you say; 'all in the words'. I would assume from their obfuscation that the answer is yes, prisoners have been fed contaminated food. Considering prison food is bought at rock bottom prices I would have thought it likely, thus my request.
