Dear Kirklees Borough Council,

I am looking for data on homeowners that are behind on their mortgage payments.

They may have had a court hearing and have fallen into arrears.

We buy houses quickly so we want to offer the vendors a solution to this and offer our service.

I know the court hearings are public data and it can be requested, so could you please supply us with this data?

I am writing in response to your request dated 29 April 2018.

I regret to inform you that “Josh” is not a valid name for the purposes of Section 8(1) of the Freedom of Information Act 2000.

Section 8(1) of the FOIA sets out the requirements of a valid request for information and says that a request must, amongst other things, "state the name of the applicant and an address for correspondence". The ICO has issued guidance on what is an acceptable name and states that the use of the phrase "the name of the applicant" in section 8(1) (b) indicates that the real name of the applicant should be used when requesting information.

Guidance is available from: https://ico.org.uk/media/for-organisatio... paragraph 25 refers. The Information Commissioner considers that a relatively informal approach is appropriate and therefore title and / or first name with a surname satisfies the requirement for provision of a real name, as does the use by a female applicant of her maiden name. The prime consideration is whether enough of a person's full name has been provided to give a reasonable indication of that person's identity.
In order for your request to comply with this requirement, I would be grateful if you could provide your full name.

Irrespective of this, the Council does not hold the information requested.

If you are not content with the handling of your request, you have the right to ask for an internal review. Requests for internal reviews should be submitted within 2 months of the date of receipt of the response to your original request and should be addressed to the Monitoring Officer, 1st Floor, Civic Centre 3, Market Street, Huddersfield HD1 2EY.
