FREEDOM OF INFORMATION REQUEST – Ref No: 009460

 

Thank you for your request of 7 June 2021 where you requested a copy of
our HMO register.

 

I can confirm that Mansfield District Council holds this information.  The
information is exempt under Section 21 of the Freedom of Information Act
(FOIA), because the information is accessible to you, as it is already in
the public domain.  The Council is able to fulfil its duty under Section
232 of the Housing Act to make this information available as a full
version of the register is available for inspection upon appointment at
the Council.  The Housing Act 2004 does not obligate the Council to
provide this information electronically, nor does it negate the Council’s
commitment and responsibilities under data protection legislation.  In the
interests of advising and assisting, the Council has attached a document
with many details of the HMO register provided.  Certain personal data has
been removed as, whilst a matter of public record, the Council must still
process this in accordance with the Data Protection Act 2018 and the GDPR.
 The Council considers the means of distribution important here, and
disclosure of the data electronically creates an unfair ease of access to
such a large number of people which could potentially breach the first
data protection principle in Article 5 of the GDPR.

 

This is an absolute exemption and there is therefore no requirement to
consider the public interest.

Most of the information that we provide in response to Freedom of
