DKILLEAN, Borders College

Dear Mr MacLean,
We publish all of our equality policies and plans on our website at
[1]www.borderscollege.ac.uk these have been updated to comply with the
Equality Act 2010 and to meet the general public duty.  We hold LGBT
charter mark offering training to our staff on LGBT matters.  We have LGBT
representation on our equality and diversity training.  We are running two
training session tomorrow for staff on transgender issues with input from
LGBT Youth.  It is a requirement that all staff undergo equality training
as part of their induction.

Many of our employment policies refer to the equality requirements we
place on staff.  This covers all 9 protected characteristics rather than
being specific about a specific group of people.  You can find all of our
policies on our website.

Yours sincerely
David Killean

Dear DKILLEAN,

Please may the collage explain the purpose and legal nature of providing services with an (over 18only) condition.

Thank you.

DKILLEAN, Borders College

Dear MacLean,
I am not sure that I understand your question.  We do not discriminate by
age.  Transgender students have the same entitlement to our services as
anyone else no matter what age they are.

In Table 1: Protected Characteristics, it states (Over 18s only)

Yours sincerely,

MacLean

DKILLEAN, Borders College

Dear MacLean
There are exceptions within the act and services to under 18s is one area
where this applies.  In the case of under 18s the act allows for
differentiation of service and allows service providers to exclude under
18s from certain services.  You can get further details from the Act,
Schedule 3.  In practice at the college it does not mean we exclude under
18s from any education provision but we do act differently in certain
aspects of what we do, if for example, an incident involves an under 18.

Dear DKILLEAN,

In what way may the colledge act diffrently ?

MacLean

DKILLEAN, Borders College

For example, College will ask for certain consent from parents of under
18s, Students under 18 are entitled to EMA rather than bursary.
