Dear Mr Westropp,

I write in response to your email of 7 February 2017 in which you
submitted an information request to the ICO. Your request has been dealt
with under the Freedom of Information Act 2000 (FOIA) and our response is
below.

In your 7 February email you asked;
 
“Can you please tell me the names of companies and individuals who have
been found in breach of The Privacy and Electronic Communications (EC
Directive) Regulations 2003 and the associated fines for these breaches
please. (From its inception until today).”
 
Our response
 
I can confirm we hold information within the scope of your request. The
information you have requested is information exempt from disclosure under
section 21 of the FOIA as it is information reasonably accessible to you
by other means.

This spreadsheet contains details of all monetary penalties issued for
breaches of the Privacy and Electronic Communications regulations (PECR).
The ICO was only granted the power to issue monetary penalties in April
2010 so there are no penalties issued before this date, and therefore no
additional penalties dating back to the inception of the PECR regulations.
 
It may be helpful to add that we also publish a lot of information about
our PECR casework more generally, including details of cases we have dealt
with that have not resulted in us issuing a monetary penalty. Data sets
listing all of our completed DPA, FOIA and PECR casework are available on
our website at the link below and these may be of interest to you.

The data sets include information about the public concerns and incidents
self-reported to us by data controllers. The data sets are published in a
reusable format and include:
 

* Our reference number for the work completed;
* The type of work and the legislation it falls under;
* The name of the organisation responsible for the processing of
personal information;
* The sector the organisation represents;
* The nature of the issues involved;
* The date the work was completed; and
* The outcome following our consideration of the issues.

interest. This is updated each month with information about our ongoing

Next steps / review procedure
 
If you are dissatisfied with the response you have received and wish to
request a review of our decision or make a complaint about how your
request has been handled you should write to the Information Access team

working days of receipt by you of this response. Any such request received
after this time will only be considered at the discretion of the
Commissioner.
