Historic annual police pension increases

Dear Government Actuary’s Department,

Annual police pension increases were based on the Retail Price Index (RPI) until 2010, when it changed to the Consumer Price Index (CPI). I am unsure at what point the RPI started to be used.

Could you please provide a complete list of pension rises for police pensions from 1960, or as far back as 1950 if you have them. There may be some anomalies where the indexes were not used such as recent Government austerity, so I'm interested in what the actual rises were rather than what they should have been.

Please specify the day, month and year of the rise (i.e. when it should be applied) alongside the percentage rise.

The Injury On Duty Pensioners Association (‘IODPA’) is a UK charity, with a registered number of 1174473, which can be confirmed at the Charity Commission’s website.

We are also registered with HMRC for tax purposes.

Our constitutional model is that of a Charitable Incorporated Organisation (‘CIO’) which is a legal form of corporate body having its own legal personality. This means that the law considers the ‘Charity’ to be a person in the same way as an individual and the legal capacity to do many things in its own name that a person can do.

The purpose of the IODPA is to support injured police officers regarding ill-health retirement, injury awards and subsequent injury reviews. Part of that process is to seek information into current processes and practices from police forces, HO departments and other parties that either have statutory duties or commercial interests in this area.

IODPA has made a perfectly valid request that is in keeping with its charitable aims, is in the public interest, and is particularly relevant to our members. We have not submitted any previous requests to you.

14. A requester can be an individual, a company or an organisation, but in each case Section 8(1)(b) requires that a request for information must include the name of the requester.

35. If the request is from a company, then the authority should accept either its full registered name or a name that exists as a legal entity (such as a trading name) as valid.

37. Again, companies’ names should generally be accepted at face value, but in any case where the authority has reason to verify the authenticity of the company, it should check Companies House or the Charity Commission Register to clarify whether it is a genuine organisation.

As we have provided the full name and number of the charity we consider that we have provided sufficient information to satisfy section 8(1)(b) of the Freedom of Information Act.

Who can make a freedom of information request?

Anyone can make a freedom of information request – they do not have to be UK citizens, or resident in the UK. Freedom of information requests can also be made by organisations, for example a newspaper, a campaign group, or a company.

In December 2017 Hampshire Constabulary received two requests from a group called the ‘Hampshire Police Monitoring Group’ -

This group does not have the legal status that we have, but a name was also requested in this case as well. The matter was referred to the ICO and on the 6 June 2018 the ICO under case reference number FS50735319 made the following decision –

“As you have pointed out, an organisation name is a valid name for the purposes of section 8 of the FOIA (which sets out the criteria for a request to be valid).

Although the Commissioner accepts that in some instances it might be necessary to verify the authenticity of an organisation before accepting its request, from the information I currently have before me, I think that in this case there is sufficient information in the public domain to indicate that HPMG is a genuine organisation (albeit it may be the case that it is an informal association of individuals with no ‘official’ status). I am also satisfied that there is information in the public domain which confirms that the requests were made by HPMG, and not by someone masquerading as that organisation. The Commissioner therefore considers that these requests were valid for the purposes of section 8 of the FOIA.”

I therefore request that you now process the original request and provide the information as originally requested.

The HO have accepted that a charity is a legal entity and can rightly ask questions and receive replies in its own right without having to provide any named individuals associated with the charity. The HO have answered in full via email to the charity.
