Response

 

1.       We have consulted our contractor Costain and CH2M and they
consider that their approach to quality and the WMTN (What Matters to Me)
model for delivering quality including the links to the financial model to
be commercially sensitive information, the release of which would be
likely to prejudice their commercial interests and undermine their ability
to compete on the current market. The commercial element is spread
throughout the document – backing up the way in which they will provide
Service Delivery. The Quality sections comprise details of the resources
required for the production of their Commercial Bid. They also consider
that the way they have shaped the overall contract and the innovation
behind the format of their presentation is unique in the current Highways
Maintenance sector.

 

Section 43(2) FOIA provides that we may withhold commercially sensitive
information if it is in the public interest to do so. We are permitted up
to 20 working days to carry out this public interests test and therefore
we will provide our final response by 24/1/2017

 

2.       Below are the fixed annual prices for the services provided under
the Highway Infrastructure Services Contract 2016;

 

Fixed annual price costs for drainage maintenance (which includes gully
emptying) – £504,139.83

Fixed annual price costs for reactive and emergency responses (which
includes pothole repairs)  - £1,463,710.61

Fixed annual price costs for the control of vegetation (which includes
grass cutting) - £613,031.73

Fixed annual  price costs for the winter service (which includes gritting)
- £986,697.89

 

3.       Attached is the instructions for Tenderers. Please refer to pages
18-22 for the specific details regarding the scoring methodology used.

 

4.       Please find performance framework attached.

 

5.        This information is intended for future publication in the
annual report. Section 22 FOIA therefore exempts this information from 
disclosure prior to the intended publication, if it is in the public
interest. We are permitted up to 20 working days to carry out this public
interests test and therefore we will provide our final response by
24/1/2017

Thank you for your latest reply and the information you have supplied, however I am not completely satisfied with the answer to question 1. I would therefore like to modify my question to the below.

1. In accordance with the provided Instructions for Tenderers clause 14.8 the successful bidders responses will be added to the works information and incorporated in to the contract. I would like you to send me the completed works information of the contract without any financial information. This information will allow users of the highway to know the service levels being required and provided by the new Highway service provider.

2. Thank you for sending the performance framework would you be able to send me the performance indicators for the contract.

3. The provided Instructions for Tenderers Clause 7.12 invites bidders to request that certain information is not disclosed or published did Costain do this at the time of bidding? If so the clause states. Requests for non-disclosure under the Freedom of Information Act 2000
must accompany the tender and include:
• Clear and substantive justification.
• A time limit when any confidential information could be disclosed.

Section 43 – commercially sensitive (question 1)

 

We acknowledge that there is a public interest in the disclosure of the
detail in contracted services provided to a public authority in order to
ensure transparency and accountability in matters relating to public
money. Also, that such transparency promotes public understanding,
safeguards democratic processes and helps to ensure good decision-making
by public bodies. This in turn upholds standards of integrity, in ensuring
justice and fair treatment for all, in securing the best use of public
resources and in ensuring fair commercial competition in a mixed economy.

 

However, given that disclosure under the FOI Act is considered to be made
to the public at large and not just to the individual requester, we have
taken into account that the requester’s private interests are not in
themselves the same as the public interest and that what may serve those
private interests does not necessarily serve a wider public interest.

 

We consider that releasing this sensitive information into the public
domain is likely to result in prejudice to the commercial interests of the
Council and to those of Costain and CH2M. This is because disclosure would
allow competitors to analyse the detail to their own competitive
advantage. This has the potential to damage our relationship with those
our supplier and undermine their effectiveness and competitiveness. This
in turn would be likely to have a negative effect on the Councils ability
to achieve best value in relation to the services it purchases. It is
clearly in the public interest for local authorities to maintain the best
possible use of resources in order to minimise the use of public funds.
This is particularly relevant in the current financial climate, where the
County Council is required to secure significant savings and reduce the
burden on the public purse.

 

Therefore, we believe that the public interest in maintaining the
exemption outweighs the public interest in favour of disclosure. The
information that we have assessed as exempt will not be disclosed.

 

Section 22 – Future publication (question 5)

 

We have now completed our public interest test. There is a public interest
in the release of information to enable individuals to understand
decisions that affect their lives and in some cases to challenge them.
There is also a public interest in the release of information to enable
the public to understand and participate in debates of importance. The
release of information will also often help the public understand why
public authorities have made the decisions that they have.

 

There is a public interest in permitting public authorities to publish
information in a manner and form and at a time of their own choosing. In
order for the County Council to effectively conduct its public affairs,
the general publication of information should be a planned and managed
activity. Where a decision has been taken in principle to publish, the
County Council has a reasonable entitlement to make its own arrangements
for doing so. In this case, arrangements are in place for publication this
year.

 

There are practical disadvantages of immediate disclosure.  The reports
are not complete and premature disclosure may result in unnecessary public
concern which is clearly not in the public interest.  We will not be
releasing the requested information ahead of the intended publication.
