CORPORATE INFORMATION GOVERNANCE UNIT
Dear Caerphilly County Borough Council,
Thank you for your request for clarification. You will understand the inherent difficulty in asking for your records to be pre-filtering by those who do not have purview over them. However, it seems reasonable to accept your request at face value and give a little extra guidance.
For the avoidance of doubt and to answer your question directly, you ask, "Can you please clarify what you mean by "your correspondence"?"; Correspondence has its dictionary meaning, both written and electronic.
Last year I requested information on the road over Mynydd Machen. In your reply, you mention various discussions and consultations. I later met with representatives of your Highways and Environmental Health departments, who again referred to discussing the matter internally and externally. Albeit the detail of the correspondence and with whom are largely unknown. Accordingly, I would like to understand more about these.
If it helps in any way, I am interested in,
-correspondence to and from your Highways Department,
- (separately) correspondence to and from your Environmental Health Department.
They will undoubtedly be able to provide a timescale for the obstructions and indicate who they were in discussion.
Whilst I understand the request for clarification, it is worth mentioning that the roads in question are minor are unlikely to have generated a great deal of correspondence. Consequently, I am confident my original terms of request identify the particular thing I wish to know more about and will not result in work above that permitted by the 2000 Act.
Yours sincerely,
Mr Jones

Dear Caerphilly County Borough Council,
Please pass this on to the person who conducts Freedom of Information reviews.
I wish to formally appeal your response to my FOI enquiry as I believe you have provided an untrue statement. This is a serious matter.
You state, "We confirm that there is no recorded information held by both Highways and Environmental Health on this matter", whereas I know of communications from myself and others that fall within the scope of the request.
Possibly, you know of the information requested but have either withheld or filtered it? You are reminded of your s.16 duty under the 2000 Act, "It shall be the duty of a public authority to provide advice and assistance, so far as it would be reasonable to expect the authority to do so, to persons who propose to make, or have made, requests for information to it."
Your response advises that the Council will consider an appeal against your decision, albeit no time limit is given to make that appeal, and I trust my request observes this statement.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/h...

Mr Jones
