High Court, Family Division - Cases where there was more than one barrister for one party (and minimum one of the barristers was paid through legal aid)

Vinzenz Zinser made this Rhyddid Gwybodaeth request to Legal Aid Agency

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Roedd y cais yn rhannol lwyddiannus.

Dear Legal Aid Agency,

for High Court, Family Division in child care cases (e.g. contact, contact enforcement, defining residence, wardship) kindly let me know

(1) the number of cases where there was more than one barrister representing the party who was on legal aid. (If there are cases where one barrister was on legal aid and there was another barrister for the same party free of charge or privately paid I would also like to know if this can be retrieved)

(2) what was the reason for ?

(3) How is this regulated ?

(4) Who approves this ?

(5) the number of cases dealing with The Hague Abduction

(6) the number of cases where EC2201/2003 was involved

(7) was there legal aid given to the other party ?

(8) Was the other party (parties) equality represented ?

(9) As this seem to be the real difficult cases, the names of the 2nd and additional barristers and their qualification. With the 2nd additional I mean the better qualified, higher ranked barrister.

Kindly let me know this for the years:
(A) 2014
(B) 2013
(C) 2012
(D) 2011
(E) 2010

Yours faithfully,

Vinzenz Zinser

Dear Information Governance (LAA),

in saying:
'I am unable to confirm whether the Ministry of Justice holds the information you have requested. On this occasion, the cost of determining whether we hold the information would exceed the limit set by the Freedom of Information Act and, as a result, I will not be taking your request further. In this letter I explain why that is the case.'
you even questing if there are such cases. So i need to prove first that there are such cases.
Therefore I refine the request. Additionally to what I have been asking, look only for cases where the QC Barrister Marcus Scott Manderson has been involved and was paid by legal aid. Mr Scott-Manderson is too expensive to act as barrister in normal cases.

Yours sincerely,

Vinzenz Zinser

Dear Information Governance (LAA),

re your question: "However, I remain unclear if your request of 28 July relates to your request ref:98533; and if so, in what way it relates"

Originally I had asked for all cases where there was more than one barrister representing one party.

Then you told me it takes too much time. Therefore I have reduced the work in requesting only cases where there was more than one barrister and one of the barristers was Marcus Scott-Manderson. This should reduce the amount of work.

Yours sincerely,

Vinzenz Zinser

Dear Information Governance (LAA),

base on my original request, already reduced to Mr Scott Manderson it came out that there could be max 48 out of 593 (200+393) cases. Still it was said, its too much work.

(A) Therefore I reduce the timeframe to 2013 and 2014. If it is still to much work reduce it to 2013.

(B) But I would also like to know how much money has been paid in these cases to the individual barristers when Mr Scott Manderson and another barrister was there.

(C) Also I would like to know the court ruling as I am not aware that a Litigant in Person can bring two McKenzie Friends with him.

Yours sincerely,

Vinzenz Zinser
