I would like to make the following Freedom of Information Request.

Could you please send me the United Kingdom's list of hazardous labour for under-18s, as required by the Worst Forms of Child Labour Convention (ILO Convention 182). Could you also tell me when the UK's list of hazardous work is next due to be reviewed?

Dear Health and Safety Executive,

Thank you for your response to my Freedom of Information request. Can you please clarify something in your response? You stated that "HSE does not provide a list of hazardous labour for under-18s, and there are no plans to introduce one. To comply with ILO Convention 182 HSE provides guidance to employers..." Can you confirm that the UK Government does therefore not have a list of hazardous labour for under-18s to comply with ILO Convention 182?

Dear Charlotte,

Thank you for your request for further clarification relating to Health and Safety Executive's (HSE) response to your original Freedom of Information request reference no. 201810204.

To comply with ILO Convention 182, HSE provides guidance to employers on how to access and manage risks for young workers through the risk assessment process. In respect of hazardous work, HSE guidance defines the types of work which could damage the health, safety or wellbeing of children under 18, so they are protected against these types of work. ILO Convention 182 does not ask organisations to publish a list of hazardous work for under 18s.

HSE guidance states that under the Management of Health and Safety at Work Regulations 1999, an employer has a responsibility to ensure young people employed by them are not exposed to risk due to lack of experience, being unaware of existing or potential risks and/or lack of maturity. An employer must consider: the layout of the workplace; the physical, biological and chemical agents they will be exposed to; how they will handle work equipment; how the work and processes are organised ; the extent of health and safety training needed; risks from particular agents, processes and work. These issues are outlined in detail in the guidance along with other issues that an employer needs to take into consideration.
