Dear Lothian and Borders Police,

I hear by request the following information in persuit of HM Freedom of information (Scotland) Act 2002 from LOTHIAN AND BORDERS POLICE.

May the respondent supply the applicant with the following information or data that would address the following questions below:

A) How many police office holders regardless of rank, have criminal convictions against there name that relate to any offence of a racist or religious hate aggrevation within the constabulary ?

I ask that such a count be presented to me in accordance to each of the constaularies territorial divisions. I do not seek the identification of any person or information contary to HM Data Protection Act 1998.

Freedom of Information Request - Citizens Advice Bureau

Thank you for your email dated 26th October 2012 regarding the above.

Section 8 of the Freedom of Information (Scotland) Act 2002 requires that when making a request for information an applicant must provide his or her name, together with an address for correspondence. While the Scottish Information Commissioner deems that an e-mail address is sufficient for the purposes of the Act, he has issued guidance which states that an applicant must provide his or her own name when making a request. The reason for this is that any appeal to the Court of Session in Scotland in connection with a request must be made using the true name of the applicant and this must be the name used in the original request to the public authority.

I would be grateful if you could provide this information, and a response to your FOI will be completed in due course.

I refer to your below email, which has been dealt with under the terms of the Freedom of Information (Scotland) Act 2002.

With regards to your questions, I can advise that no Police Officers have criminal convictions against their name that relate to offences of a "racist or religious hate aggrevation" within the Lothian and Borders Police Force area.

Freedom of Information Request - Hate Crime Offences

I refer to your email dated 20th February regarding the above. I must advise that I am not responding under the terms of an internal review, as Lothian and Borders Police have met their obligations under the Freedom of Information (Scotland) Act 2002. That is to say we have answered the question you asked.

All cases involving the discipline or criminal investigation of a police officer are dealt with by the Professional Standards Department. A search of their record sets, using the criteria that you supplied, brought back a nil return.

I trust this explains the position.
