Thank you for your email received by Transport for London (TfL) on 26
October 2018.

Your request has been considered in accordance with the requirements of
the Freedom of Information Act and our information access policy. I can
confirm we do hold the information you require.

However, we are refusing your request under section 14(1) of the Act. You
asked for all correspondence relating to complaints about the bus route
H25. We have located in excess of 160 potentially relevant complaints
about this bus route.  By their nature, these recorded complaints contain
a significant amount of personal data such as phone numbers and email
addresses and so, whilst this process of redaction does not feature as
part of our considerations on whether the the ‘appropriate cost limit’ of
£450 set by the Freedom of Information (Appropriate Limit and Fees
Regulations 2004) might apply, the burden created by non-specific request
for emails is significant.

The Information Commissioner describes such requests as “fishing
expeditions” as the requesters “have no idea what information, if any,
will be caught by the request”. Such requests are likely to be vexatious
if they:

·        Impose a burden by obliging the authority to sift through a
substantial volume of information to isolate and extract the relevant
details;

·        Encompass information which is only of limited value because of
the wide scope of the request;

·        Create a burden by requiring the authority to spend a
considerable amount of time considering any exemptions and redactions;

Our view is that all three of these examples apply in this instance. In
order to process in excess of 160 complaints that meet the requirements of
your request, we would need to manually review each of these complaints
one by one. It would be necessary to spend time considering exemptions
which might be applicable to the information caught by the request,
particularly in relation to personal data.

 

We feel this wide ranging request for all complaints recorded about the
bus route H25 will very likely encompass information which is only of
limited value. In that respect, it is noteworthy that your request is not
for information on any specific issue, such as lateness, driver behaviour,
speeding etc.   We consider the burden of retrieving, reviewing and
redacting the information would be disproportionate to the benefit of
providing it. Therefore, due to the unfocused scope of your request, we
are refusing it under s.14 of the FOI Act.

 

If you would like to re-submit a more specific request then we will, of
course, consider it. For example, a request for complaints about the bus
route on a particular issue as suggested above.
