Thank you for your reply.You said and i quote ' It is not,
in general, part of the functions of the Home Office to issue guidance to police
forces as to how they should discharge their statutory obligations under the
Freedom of Information Act ' so in some instances therefore as indicated above the home office would become involved ... Therefore could the home office supply me with the relevant information to the following question,

1) Are the home office directly involved in issuing specific guidelines or advice to UK police forces specifically in the FOI requests made by Martin McGartland and subsequent replies given to Mr McGartland by various UK police forces.Yes or no ?

Dear FOI Responses,
I’m not requesting an internal review at this stage.

I note what you have said: “The Home Office does not hold the information you have requested. It is not, in general, part of the functions of the Home Office to issue guidance to police forces as to how they should discharge their statutory obligations under the Freedom of Information Act.”

However, with respect the Home Office have not answered my question nor have they dealt with my request correctly.

Are the Home Office saying that they have NOT issued any kind of guidelines or advice to various UK police forces, including Northumbria Police, concerning FOI requests from or relating to Martin McGartland?

I am requesting all recorded information relating to the above.

Dear Mr Hayward,

 

Your original request asked for any information relating to "guidelines
[that] have been issued to various or all UK police forces by the Home
Office when dealing with FOI requests from Martin McGartland in relation
to any\all of Mr McGartlands said requests to UK police
forces\Authorities".  Our response was that we hold no such information.

 

In your e-mail of 12 April you asked "Are the Home Office directly
involved in issuing specific guidelines or advice to UK police forces
specifically in the FOI requests made by Martin McGartland and subsequent
replies given to Mr McGartland by various UK police forces. Yes or no ?". 
We answered that question in our e-mail of the same date: "No".

 

We are not sure how to make this any clearer, but in answer to your most
recent question: yes, that is what we are saying.

Martin McGartland (Account suspended) left an annotation ()

Theresa May MP, Home Secretary (http://www.tmay.co.uk/) has claimed in a written, signed statement (dated 12-02-2014) to the High court in London that she can not confirm or deny that Martin McGartland was an agent. However, the Home office, Jack Straw, Home office solicitors have already done so, both in public (press release), in correspondence and by speaking to the media about the Martin McGartland. Martin McGartland says; "The reason why Theresa May MP, Home Secretary and MI5 are now misleading public, Court is in a desperate attempt to try to get a Judge, court to agree to a CMP aka Secret hearing. I say this is because Theresa May MP, Home Secretary, MI5 and HMG want to cover-up their own wrongdoing and corruption while dealing with my (Martin McGartland case)."

The Home Office and Jack Straw have already confirmed a number of times that Martin McGartland had been an agent.

Why is the Home Office and even a Government Minister now misleading the Court and the public by now claiming they can not confirm or deny that Marin McGartland was, had been a Spy, agent. The above evidence, penned by themselves, proves they have already confirmed he was, they have done so many times both in public and also in written correspondence.
