Dear Mr Onslow,

 

I am emailing to update you regarding your Freedom of Information (FOI)
request to the House of Lords (copied below). We are currently considering
two qualified exemptions, sections 24(1) and 31(1)(a), in relation to
information that falls within the scope of your request. We now require
more time to consider the public interest test in relation to these
exemptions. We therefore need to extend the deadline for responding to
your request, in accordance with section 10(3) of the FOI Act.

necessarily fall under clear headings of (for example) ‘security guidance’

Please find attached our response to your request (copied below) to the
House of Lords Administration.

 

Section 50 of the Freedom of Information Act 2000 provides that any person
may apply to the Information Commissioner for a decision whether, in any
specified respect, a request for information made by the complainant to a
public authority has been dealt with in accordance with the requirements
of Part I of the Act. In this context you should have regard to the fact
that under section 2(3) the exemption conferred by section 36 is an
absolute exemption and to the terms of section 36(7).

However, if you have a complaint that relates to another aspect of the way
in which your request has been handled then you would, of course, be
entitled to ask the House of Lords to conduct an internal review. This
should be addressed to [2][email address] or to the Freedom of
Information Officer, House of Lords, London SW1A 0PW and explain clearly
the nature of your complaint. Arrangements will be made for someone who
has not been involved in dealing with your request to conduct an internal
review within 20 working days. You should note that we will not normally
accept an application for internal review if it is received more than two
months after the date our response was sent. Any such request received
after this time will only be considered in exceptional circumstances.

 

If, following this review, you remain dissatisfied with the House’s
treatment of your request for information you may then take your complaint
to the Information Commissioner at Wycliffe House, Water Lane, Wilmslow,
Cheshire, SK9 5AF.
