Dear Shrewsbury Colleges Group

1) Since merger, please provide the number of disciplinary investigations undertaken at Shrewsbury Colleges Group.For avoidance of doubt, I mean investigations which have taken place before any formal disciplinary procedure has been invoked. Please provide details of this on an annual basis until present date.

2) In addition to the above information please provide how many of these investigations went to a formal disciplinary procedure and what type of disciplinary action was issued on each occasion (if any) in terms of your own procedure such as No Action, Written Warning, Final Written Warning, etc.

3) Please also provide details of the number of staff reviewed both formally and informally under your Staff Capability Policy and state the number of cases, year on year since merger, which reached first formal stage of this policy.

Thank you for your Freedom of Information request, please find below the response.

1) Since merger, please provide the number of disciplinary investigations undertaken at Shrewsbury Colleges Group. For avoidance of doubt, I mean investigations which have taken place before any formal disciplinary procedure has been invoked. Please provide details of this on an annual basis until present date.

Informal disciplinary investigations prior to any formal disciplinary procedure are not recorded; to record them would undermine their informal nature. The exception to this is if HR are requested to support with allocation of a letter of concern. There have been six occasions where informal disciplinary investigations occurred and were supported by HR, a breakdown by year is below.

2016 - 1
2018 - 3
2019 - 2

2) In addition to the above information please provide how many of these investigations went to a formal disciplinary procedure and what type of disciplinary action was issued on each occasion (if any) in terms of your own procedure such as No Action, Written Warning, Final Written Warning, etc.

In total there have been 28 disciplinary cases since merger, 6 of these escalated from informal as mentioned above . Of these:

4 resulted in no sanction
6 resulted in a warning being issued
6 resigned during investigation
6 left under an agreed settlement
4 dismissed
2 are ongoing

3) Please also provide details of the number of staff reviewed both formally and informally under your Staff Capability Policy and state the number of cases, year on year since merger, which reached first formal stage of this policy.

Central records are not kept for informal capability because the process is designed to remain informal. There have been 8 cases of formal capability management since merger, as follow:
2016 one case ended in settlement
2017 two cases one made required improvements, the other was settled
2018 one case ended in settlement
2019 four cases two resigned mid process, one made required improvements and one is ongoing
2020 no cases
