Grenfell Tower - Status of the Investigation

Dear Metropolitan Police Service (MPS),

It was obvious in the aftermath of the Grenfell Tower disaster, that there was likely to be serious criminal misconduct involved. Fraud, negligence, recklessness, corruption, even manslaughter.

At first police press officers were hesitant to give a figure for the number of victims, and frequently qualified their figures by reference to those "identified" or "resident", rather than offering unconditional numbers regardless of their name/residence status.

In the days that followed, it was surprising to me that no offices were raided, no arrests were made. I believe, at the time of writing, no one is in custody or on bail, no premises have been raided.

As time has goes on, I fear Grenfell is becoming yet another example of UK police corruption & cover up, in a similar fashion to the Hillsborough case, the shooting of John Charles de Menezes, the Mark Kennedy 'spycops' scandal, News of the World Hacking, the Stephen Lawrence investigation, Phorm ,or the execution of Daniel Morgan.

Please will you disclose to me
1) How many victims were there in total without qualification - regardless of identity/status/nationality - and how many of those victims remain to be identified
2) How many people have been arrested, charged, bailed, prosecuted, convicted over the Grenfell Tower fire
3) If none; what is the current obstacle to making arrests; eg lack of evidence, lack of witnesses, lack of resources, no crime detected
4) How many premises have been raided to secure vulnerable evidence against destruction and alteration by suspects
5) Confirm or deny that Police officers who are members of the Freemasons have been barred from participating in the investigation(*), and if not, how many officers working on the inquiry are members of the Freemasons

SEARCHES TO LOCATE INFORMATION

To locate the information relevant to your request searches were conducted
within the MPS.  The searches located information relevant to your
request.

DECISION

This letter is to inform you that it will not be possible to respond to
your request within the cost threshold.  This response serves as a Refusal
Notice under Section 17 of the Freedom of Information Act 2000 (the Act).
 Please see the legal annex for further information on the exemptions
applied in respect of your request.

REASONS FOR DECISION

To Confirm or deny that Police officers who are members of the Freemasons
have been barred from participating in the investigation, and if not, how
many officers working on the inquiry are members of the Freemasons would
require extensive enquiries into each officers background via the
Directorate of Professional standards and MPS Vetting. I can confirm that
Vetting is mandatory for all Police Officers and Police Staff, but to
provide a definitive accurate answer to your question would take hundreds
of hours reading vetting forms and enquiries via the Directorate of
Professional Standards.

We therefore estimate that the cost of complying with this request would
exceed the appropriate limit. The appropriate limit has been specified in
regulations and for agencies outside central Government; this is set at
£450.00.   This represents the estimated cost of one person spending 18
hours [at a rate of £25 per hour] in determining whether the MPS holds the
information, and locating, retrieving and extracting the information.

DUTY TO ASSIST

I would like to provide you with advice as to how you may narrow your
request so that it does not exceed the appropriate limit.

If you were to submit a new FOIA request, I can provide information in
relation to questions 1 to 4 within the cost limit, subject to any
exemptions that may apply.

Section 17(5) of the Act provides:

for complying with section 1(1), give the applicant a notice stating that

Section 12(1)&(2) of the Act provides:

(1) Section 1 does not oblige a public authority to comply with a request
for information if the authority estimates that the cost of complying with
the request would exceed the appropriate limit.

(2) Subsection (1) does not exempt the public authority from its
obligation to comply with paragraph (a) of section 1(1) unless the
estimated cost of complying with that paragraph alone would exceed the
appropriate limit.

Section 16 of the Act provides:

(1) It shall be the duty of a public authority to provide advice and

(2) Any public authority which, in relation to the provision of advice or

Further to our earlier correspondence dated 07/08/2018, I am now able to

Section 10(1) of the Freedom of Information Act 2000 states:

'Subject to subsections (2) and (3), a public authority must comply with

working day following the date of receipt.'

In the circumstances of your request, neither the information requested
nor a refusal notice was provided to you within 20 working days.
Therefore, the MPS have not complied with the requirements of Section 10
of the Act.

With respect to the delay in providing you with a response, I have made
enquiries and a response to your FOIA request has been drafted and
circulated to the business area concerned  for approval and quality
assurance.

PREVIOUS REQUEST 2018050000986: It was obvious in the aftermath of the
Grenfell Tower disaster, that there  was likely to be serious criminal
misconduct involved. Fraud, negligence,  recklessness, corruption, even
manslaughter. At first police press  officers were hesitant to give a
figure for the number of victims, and  frequently qualified their figures
by reference to those "identified" or  "resident", rather than offering
unconditional numbers regardless of their  name/residence status. In the
days that followed, it was surprising to me  that no offices were raided,
no arrests were made. I believe, at the time  of writing, no one is in
custody or on bail, no premises have been raided. As time has goes on, I
fear Grenfell is becoming yet another example of UK  police corruption &
cover up, in a similar fashion to the Hillsborough  case, the shooting of
John Charles de Menezes, the Mark Kennedy 'spycops' scandal, News of the
World Hacking, the Stephen Lawrence investigation,  Phorm ,or the
execution of Daniel Morgan. Please will you disclose to me
1) How many victims were there in total without qualification - regardless
 of identity/status/nationality - and how many of those victims remain to
 be identified
2) How many people have been arrested, charged, bailed, prosecuted,
 convicted over the Grenfell Tower fire
3) If none; what is the current obstacle to making arrests; eg lack of

threshold allowed for FOIA requests.

On 13/06/2018, you redefined your request. FOIA reference 2018060000564
refers. You said:

On 09/08/2018, we provided a response to question 5.

On 12/08/2018, you wrote:

Unfortunately, the Information Manager (IM) with responsibility for your
requested has not provided you with a response to 4 of the questions in
your request. This was an oversight.

Section 1 of the Act states:

Section 1 (General right of access to information held by public
authorities)

Section 1(1) of the Act states:

(1) Any person making a request for information to a public authority is
entitled-
(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request, and
(b) if that is the case, to have that information communicated to him.

The MPS has not complied with Section 1 of the Act, therefore your
complaint is upheld.

Questions 1 - 4 have been resubmitted and the reference for this request
is 2018080000642. The IM will endeavour to provide you with a response as
soon as possible.

As a response to your request is currently outstanding, I am unable to
complete a full internal review in relation to your request. However,
should you be dissatisfied with the MPS response to your request, you may
request an internal review in relation to the decision.

There were 71 victims with none remaining unidentified.

Any recorded information currently held for Questions Two Three and Four
is exempt by virtue of Section 30(1)(a) (Investigations).

The recorded information held for this question which is exempt relates to
information held other than information that has already been disclosed
into the public domain (which is exempt by virtue of Section 21 but links
will be provided for you). However, some further information has been
provided to assist you with this part of your request.

Section 21 is an absolute and class based exemption. I am therefore not
required to provide you with a Harm test or Public Interest Test in the
application of this exemption.

Section 17(1) of the Act provides:

(1)        A public authority which, in relation to any request for
information, is to any extent relying on a claim that any provision in
part II relating to the duty to confirm or deny is relevant to the request
or on a claim that information is exempt information must, within the time
for complying with section 1(1), give the applicant a notice which-
(a) states the fact,
(b) specifies the exemption in question, and
(c) states (if that would not otherwise be apparent) why the exemption

Section 21 (Information accessible to applicant by other means) of the Act

Public interest considerations favouring disclosure
There is a public interest in the disclosure of the requested information,
considering the information requested relates to a high profile
investigation.

Public interest considerations favouring non-disclosure
This investigation is very much live and ongoing. It would therefore not
be in the public interest to disclose information, other than that already
disclosed, as this may risk prejudicing the investigation itself.

Balancing Test
The strongest reason favouring disclosure is consideration that there is a
public interest in this high profile investigation and how it is being
undertaken. The strongest reason favouring non-disclosure is the need to
ensure that the prevention or detection of crime is not hindered by an
adverse disclosure, which may prejudice this current investigation in any
way.
On weighing up the competing interests I have determined that the
disclosure of the information requested (other than that already in the
public domain) would not be in the public interest.  I consider that the
benefit that would result from the information being disclosed does not
outweigh the considerations favouring non-disclosure.
The public interest for disclosure is presently met by the information
already currently available within the public domain, particularly that
which has been disclosed on the MPS website to keep the public informed on
this investigation.
I appreciate this may not be the response you would have liked. However
this decision is based on the understanding that the public interest is
not what interests the public, but is what would be of greater good to the
community as a whole if the information were disclosed.
