I note that on 12 March 2019 we wrote to you requesting clarification in
order to assist us to establish the award this request for information
relates to.  Before any response from you, we indicated that we had
located relevant information and informed you we would get back to you.  I
have now had an opportunity to review this information in line with the
Freedom of Information Act 2000.

 

Following this review, I am writing to let you know that I am unable to
proceed with your request without further clarification from you.   This
is because the information located does not accurately respond to the
request you have made, as I understand it.

 

I would be grateful if you would please clarify your request and set out:

 

 a. Whether you require terms and conditions specific to ‘project 2026’ or
‘DOBBIN’ or whether you would like to see the general award terms and
conditions for awards made to British Equestrian Federation and/or
British Horse Society by Sport England?

 

I would also like to apologise for the time it has taken for us to request
this clarification.  This has been due to an FOI Team member being on
annual leave and an error in this request for information being missed.

 

Once we have received your clarification, we will progress with our

Dear FOI,

This is your second attempt at what appears to be delay and obfuscation. We are minded to write to an MP regarding this delay, as we suspect Lottery Funds are being misused and hence requesting the terms and condition for the grants.

All we know is the funds are claimed to be from you and ultimately distributed through BHS Project 2026, known also "DOBBIN", but came from Sport England, we think via the Equestrian Federation.

Only you and those organisation know what documentation exists regarding how the funds are intended to be used.

Further to your request of 12 March 2019 below for information regarding
the terms and conditions for the grant provided to either British Horse
Society or British Equestrian Federation regarding project 2026 or DOBBIN.
I note that Sport England requested clarification of your request for
information on 12 March 2019 and again on 1 May 2019, we have considered
your request and I am writing to provide you with the following
information.

 

We again apologise for the delay in being able to respond to your request
for information.   The delays have been due to Sport England having
difficulty understanding and locating information relevant to your request
and needing to seek clarifications to enable us to appropriately respond
to your request.  There were also delays due to members of a small team
being on leave during this period.  We always endeavour to comply with our
statutory requirements to respond to information requests within 20
working days, and due the circumstances outlined above, we were
unfortunately not able to do so on this occasion.  We apologise for this
and hope that this explanation satisfies your request for an internal
review.

 

We attached the information Sport England holds in relation to your
request.

 

Sport England holds information falling within the scope of your request
but, after careful consideration, we have decided that the exemption at
section 43 applies to some of it. We are therefore refusing to disclose
some of the information you have requested.

 

This is because some of the information you have requested contains
commercially sensitive information.

 

In reaching our decision we have consulted the relevant guidance issued by
the Information Commissioner’s Office and available on its website at
[1]www.ico.org.uk

 

The exemption at section 43 is an ‘absolute exemption’ and we are
therefore not required to consider the public interest test.

 

Please note that we have also removed a number of names, job titles, email
addresses and telephone numbers from the above responses because we
consider this information to be exempt from disclosure under section 40(2)
Freedom of Information Act 2000. The names and direct email addresses of
our external partners and our non-senior, non-public facing staff
constitutes personal data as defined by the General Data Protection
Regulation. Our external partners and staff have a reasonable expectation
of privacy and would not expect us to make information about their working
lives public. As such, disclosure of this information would not be fair
and in direct contravention of the first data protection principle.

 

We also note that Sport England does not hold some information you have
requested as Sport England does not fund the British Horse Society.  We
note that you requested information specific to Project 2026 or DOBBIN. 
Sport England does not hold information regarding this project.  We have
provided the information we hold regarding the terms and conditions of the
grant provided by Sport England to British Equestrian Federation which
govern the funding to British Equestrian Federation that we understand may
have been used to fund the British Horse Society and may have been used
for Project 2026 or DOBBIN.

 

This completes our response to your information request.

There is no information in the documents provided referring to the specific outputs of paying members of the public £100 for each bridleway claimed by the process that is being promoted by BHS using funding provided by you from public funds and/or Lottery.
