I am writing to confirm that the Trust has now completed its search for
the information that you requested on 23 September 2012 at 11:13 hours,
received for the purpose of Freedom of Information on 24 September 2012. 
Please accept my sincere apologies for the extended delay in responding to
your request; this was unfortunately due to the cumulative effects of
staff sickness and staff annual leave.

 

DATA PROTECTION ACT 1998: The provision of name, telephone number, e-mail
address, fax or other personal information in response to this request
does not constitute permission to process that information for the
purposes of sales or marketing telephone calls, e-mails, faxes or other
communications.   Any processing of personal or sensitive personal
information must comply with all Data Protection Principles, and in
particular 1^st Data Protection Principle:

 

“Personal data shall be processed fairly and lawfully and, in particular,
shall not be processed unless—

E+W+S+N.I.

(a)       at least one of the conditions in Schedule 2 is met, and

(b)       in the case of sensitive personal data, at least one of the
conditions in Schedule 3 is also met.”

 

and the 2^nd Data Protection Principle:

 

“Personal data shall be obtained only for one or more specified and lawful
purposes, and shall not be further processed in any manner incompatible
with that purpose or those purposes.”

 

and the 6^th Data Protection Principle – (Personal data shall be processed
in accordance with the rights of data subjects under this Act) of the Data
Protection Act, particularly in respect of the Part II, Section 11
obligations in respect of the right to prevent processing for the purposes
of direct marketing.

|I have been informed that NHS Herefordshire does hold the |  |
|information that you have requested.  Due to the fact that | |
|the information requested relates to the personal information| |
|of living individuals a public interest test has been | |
|conducted under Section 40(2) – Personal Information of a | |
|Third Party, to determine where the public interest lies in | |
|respect of that information. | |

|The Public Interest Test | |
| | |
|  | |
| | |
|As part of this test we initially considered whether the | |
|information requested fell under the definition of Personal | |
|Data as detailed in the Data Protection Act 1998:- | |

|  | |
| | |
|“’personal data’ means data which relate to a living | |
|individual who can be identified— | |
| | |
|  | |
| | |
|(a)       from those data, or | |
| | |
|(b)        from those data and other information which is in | |
|the possession of, or is likely to come into the possession | |
|of, the data controller, and includes any expression of | |
|opinion about the individual and any indication of the | |
|intentions of the data controller or any other person in | |
|respect of the individual.” | |

|As the information requested clearly identified living | |
|individuals, we then needed to consider whether disclosure of| |
|the information to the public at large would constitute a | |
|breach of the Data Protection Principles. | |
| | |
|  | |
| | |
|The primary principles applicable were:- | |
| | |
|  | |
| | |
|Principle 1 – Whether disclosure would be fair and lawful | |
| | |
|  | |
| | |
|Principle 2 – Whether disclosure would be incompatible with | |
|the specified lawful purpose or purposes for which it was | |
|originally obtained | |
| | |
|  | |
| | |
|In determining whether disclosure would be fair, we | |
|considered the following:- | |
| | |
|  | |
| | |
|·         the possible consequences of disclosure on the | |
|individual; | |
| | |
|  | |
| | |
|·         the reasonable expectations of the individual, | |
|taking into account expectations both at the time the | |
|information was collected and at the time of the request; | |
| | |
|  | |
| | |
|·         the nature of the information itself; | |
| | |
|  | |
| | |
|·         the circumstances in which the information was | |
|obtained; | |
| | |
|  | |
| | |
|·         whether the information has been or remains in the | |
|public domain; | |
| | |
|  | |
| | |
|·         the ‘freedom of information’ principles of | |
|transparency and accountability; and | |
| | |
|  | |
| | |
|·         any legitimate interests in the public having | |
|access to the information relevant to the specific case. | |
| | |
|  | |
| | |
|We then went on to consider whether disclosure would be | |
|lawful.  Due to the fact that the information requested | |
|constituted personal information as opposed to sensitive | |
|personal information, the Conditions for Processing included | |
|in Schedule 2 of the Data protection Act 1998 were | |
|considered.  | |
| | |
|  | |
| | |
|The primary Conditions applicable in this case were:- | |
| | |
|  | |

|Condition 1 – Consent | |
| | |
|  | |
| | |
|Condition 6 – Legitimate Interests | |
| | |
|  | |
| | |
|In considering whether disclosure would meet the Legitimate | |
|Interests Condition, we took account of the following:- | |
| | |
|  | |
| | |
|·         Whether there is was a legitimate public interest | |
|in disclosure; | |
| | |
|  | |
| | |
|·         Whether the disclosure was necessary to meet that | |
|public interest; and | |
| | |
|  | |
| | |
|·         Whether the disclosure would cause unwarranted harm| |
|to the interests of the individual. | |
| | |
|  | |
| | |
|Initially, we identified whether the personal information was| |
|already in the public domain legitimately.  For the remainder| |
|of the individuals whose information was not already | |
|legitimately in the public domain (including NHS Choices), we| |
|undertook a consultation exercise in order obtain consent.  | |
| | |
|  | |
| | |
|We have considered the seniority of the individuals concerned| |
|and the public facing nature of their role, together with the| |
|fact that information disclosed under the Freedom of | |
|Information Act enters the public domain.  We have also taken| |
|into account whether disclosure could cause unwarranted harm | |
|to the individuals concerned.   Following completion of the | |
|consultation exercise, we believe that in the majority of | |
|cases the public interest in disclosure outweighs the public | |
|interest in withholding the information, however, in limited | |
|instances, the balance of public interest has found in favour| |
|of withholding the information as it is felt that release | |
|would cause unnecessary or unjustified damage to individuals | |
|concerned, that element of the information has therefore been| |
|withheld under Section 40(2) of the Freedom of Information | |
|Act 2000. | |
