GP confirms ccg blocking choice in mental health

The request was refused by NHS Mid Essex Clinical Commissioning Group.

Dear NHS Mid Essex Clinical Commissioning Group and other Essex ccg.

I have dyslexia and comprehension difficulties
the CCG uses ambiguous terms a lot and drags correspondence out, both on purpose
please put my questions first and then the ccg response.

I have discussed choice in mental health with my GP
My GP has confirmed choice of provider is a legal right contrary to what the ccg unlawfully claims that choice can only be accessed by showing clinical exceptionality.

My GP has said they have discussed choice in mental health with NHS England.
The reason choice is not working in Essex is because the ccg is not following the NHS England guidance, which is based on statute law, has nothing to do with the GP or other parts of the NHS blocking the choice of provider.

1, Therefore can you please explain why the ccg keeps sending me a simple choice leaflet, “discuss with your GP”?

2, When the ccg already clearly knows the choice blocking problem has nothing to do with the GP its the ccg blocking choice unlawfully?

3, I have sent the ccg detailed NHS England guidance on choicebackin 2019 that is what the ccg should be doing to follow the law. But the ccg just ignores and refuses to answer the questions I have raised on the former, why?

4, The ccg has had discussions with NHS England regarding the CCG not following the law on choice in mental health, but the ccg has failed to change its ways, even though the ccg has agreed with NHS England to follow the law in these discussions but then continues with unlawful practices.

5, The public officers of the ccg are misleading, carrying out unlawful practices, causing patients distress and wasting their lives, and misleading wasting the time of other parts of the NHS and should be held to account for the failings personally.

6, Can the CCG please persist from this unlawful practice as soon as possible?

7, Why does the CCG insist an IFR form is used to access choice, as your confusing other members of the NHS as this form is normally used to try to show clinical exceptionality.

The CCG use of the IFR form once again shows the ccg wants to actively mislead everyone else patients and NHS staff as I have mentioned clearly at the top

this is a new formal complaint as I have only recently spoken to my GP in early 2022. And found out that the problem in the GP view is due to the ccg. So I was not aware of these very important facts in earlier correspondence with the ccg.
