On behalf of DB3 Architecture we would like to congratulate you on having been selected to put forward your proposals & bid to Government as part of the £3.6bn investment into the Towns Fund.

Under the Freedom of Information Act, we would be grateful if you could provide us with some details regarding this so as to ascertain if we can be of help:-

1. The name of the person/people who has/have been nominated to develop this Towns business plan.
2. An outline of your intentions regarding utilisation of awarded grant money.
3. If there is an opportunity for you to involve the skills & experience of an architectural company to support you in this process?

Following the Council's evaluation of your request the Council concludes that the information you are requesting has no clear public interest or purpose in releasing the information you are requesting as the purpose of the request is clearly not public accountability or transparency purposes but one of commercial activity. The information you have requested does not pass the public interest disclosure test, a fundamental part of the FOI legislation.

Without clear public interest the Council will consider requests vexatious in line with the Upper Tribunal ruling recently upheld by the Court of appeal.

Judge Wikeley indicates in para 35 & 38 that improper use of FOIA [such as no public interest] is a valid consideration to make when considering if a request is vexatious. Using FOI to gain a commercial advantage or seek opportunity over another can be included within this definition.
